초록
Against the simple dichotomy of the “Western vs. local origins” perspective, this article aims to provide a more sophisticated framework of understanding to clarify the historical origin, nature, and changes of the economic and social provisions in the Korean constitutions (1948-1987). Based on a theoretical framework of contested diffusion processes of different “legal traditions,” this research argues that the general economic principle of the Korean constitution changed from Weimar-style “social justice” via a “developmental” constitution to a liberal market economic order. The diffusion process of the “social” and “liberal market” ideas was not just one-directional, but a combination of local and national actors’ demands and responses. The Korean case shows us that these dynamic contestation of different economic ideas gained importance in so-called late-developed countries, which were “laboratories of institutional contestation.”
