Abstract

This study critically analyzes the assumption of the “Best Reading” presented as a core normative premise by the U.S. Supreme Court in the 2024 Loper Bright decision, which overruled the Chevron doctrine and declared the judiciary's independent authority to interpret statutes. The majority opinion in Loper Bright rests on the proposition that there is always a single “best reading” for ambiguous statutory provisions and that determining such an interpretation is exclusively the task of the courts. However, from the perspective of legal philosophy, statutory ambiguity encompasses not only linguistic and structural dimensions but also ‘policy ambiguity’ that requires value judgments and choices. By systematically ignoring the distinction between the cognitive domain (recognition) and the volitional domain (choice), the “Best Reading” assumption suffers from structural gaps and internal contradictions within its own interpretive methodology. While this structural shift in U.S. administrative law has instantly reverberated in Korea, significant differences exist in the constitutional frameworks of the two nations. Unlike the United States, South Korea actively enforces the principle of concrete delegation, the doctrine of legislative reservation (Parlamentsvorbehalt), the ‘essentialness theory’ (Wesentlichkeitstheorie), the judicial doctrine of ‘judgment leeway’ (Beurteilungsspielraum), and the Framework Act on Administrative Agencies. Simply adopting the judicial supremacy model of Loper Bright into the Korean legal system could result in administrative paralysis and interpretive inconsistency. Therefore, this study proposes the direction of a “Balanced Deference Model”-a Korean contextualization of the Multi-Factor Balanced Model based on the cooperation and mutual verification among the legislature, the executive, and the judiciary. To realize this model, the study offers three legislative paths: codifying the judgment leeway doctrine, establishing deference based on procedural legitimacy, and clarifying the principles of statutory interpretation for administrative agencies. As the concrete institutional design of these paths requires further sector-specific and empirical examination, this study focuses on establishing their theoretical foundations and overall direction.
