Abstract
In Korean society, various generations coexist and experience the global pandemic at the same time, from the generation that first learned about ‘AI’ as ‘Avian Influenza’ to the digital native generation that cannot think of anything but ‘Artificial Intelligence’. Many startups looking for a way out of the global economic downturn of low growth have modeled their business on digital platforms as a vanguard for reorganizing the capitalist economic order using data as raw material. As quarantine policies restricting human mobility have been implemented, non-face-to-face contact through online platforms has become a form of interaction that is no longer an exceptional or unfamiliar in daily life. In this process, platforms are becoming established as a means of creating value and a space for people who live a platfrom-centric life to find work or provide labour. Furthermore, as platforms powered by network effects expand their domains, they become an inescapable work environment for those who work and make a living within them. This article analyzes the basic concepts and characteristics of platforms that have emerged as a human labour environment, and examines how platforms that have transitioned to a capitalist business models actually function for their users through the algorithmic system that operate them. It also explores how the status of human labour can change when the business modeled platforms are accepted as a working environment, and argues that the platform work environment makes human labour invisible, microscopic, ambiguous, and informal. On the basis of this understanding, it shows the limitations of the labour protection legal system based on the contract labour model. In that model, human labour is divided and classified in several types, and then some of them are typicalized as objects of ‘complete’ right to work and protected strictly, while the rest remain atypical and it is rationalized to treat them differently as ones of ‘incomplete’ right. Lastly, it emphasizes the necessity and importance of legal and policy approaches that focus on the expandability and inclusiveness of labour protection.
