낙태 행위와 관련된 법령의 개선입법(방)안

낙태죄의 폐지여부에 대한 논의는 지금까지 사회적으로 많은 논란이 일고 있는 사안 중 하나라고 할 수 있다. 이에 대해 2019년 4월 헌법재판소는 낙태죄와 관련된 법령을 헌법불합치 결정을 함으로써 그 논란을 어느 정도 해소하였다고 할 수 있다. 그러나 그 결정이 헌법불합치라는 점에서 논란을 완전히 해소한 것은 아니라고 할 수 있다. 그래서 이제는 선택의 갈림길에 서 있다. 낙태죄를 완전히 폐지할 것인지 또는 개정할 것인지 하는 것이다. 필자는 본 논문에서 이번 낙태죄의 헌법불합치 결정에 대한 개선입법(방)안으로 두 가지 방안을 제시하였다. 하나는 낙태 전면 허용[제1방안]이고, 다른 하나는 낙태 부문 허용[제2방안]이 그것이다. 여기서 [제2방안] 즉, 개정을 선택할 경우 생각해볼 사항들은 여러 가지가 있다. 낙태결정가능기간 내지 낙태허용시기, 낙태허용사유, 낙태허용절차, 낙태허용방법 등이 그것이다. 이 중에서 헌법재판소는 결정문에서 낙태결정가능기간 내지 낙태허용시기, 낙태허용사유에 관하여 언급하기도 하였다. 필자는 [제1방안]이 타당하고, 기본적으로 이 방안에 무게를 둬야 한다고 본다. 낙태 행위는 생명존중사상의 관점과 일직선상에 놓여있는 문제라고 할 수 있고, 이러한 관점에서 볼 때 낙태 행위는 우주만물의 생생의 길을 저해하는 것이 아니라고 할 수 있기 때문이다. 그러나 우리나라의 사회 현실에 비추어 볼 때 [제2방안]을 선택할 가능성이 농후하다고 본다. 그러나 중요한 점은 배아든 태아든 모두 생명체라는 점이다. 이에 낙태 행위와 관련된 논의는 결국에는 생명존중사상의 관점과 일직선상에 놓여있는 문제라고 볼 수 있다.
Abstract
The debate on the abolition of abortion crime is one of the most controversial social issues. In April 2019, the Constitutional Court resolved the controversy to some extent by making a constitutional discordance adjudication regarding a law related to abortion crime. However, it can be said that the decision was not completely resolved in that it was constitutional discordance. So now you are at a crossroads of choice. Whether to abolish or revise abortion crime completely. In this paper, I proposed two ways to improve the legislation of the abortion crime about constitutional discordance adjudication. One is the allow abortion all-over [first option], and the other is the allow abortion sector[second option]. There are a number of things to think about when you choose the [second option], or revision. It is the abortion decision period or abortion allowance period, abortion reason for allowance, abortion allowance procedure, abortion allowance method. Among them, the Constitutional Court also referred to the abortion decision period or abortion allowance period. I think that [First Option] is valid, and you should basically put weight on it. The act of abortion is a problem in line with the viewpoint of respect for life, and from this point of view, it can be said that the act of abortion does not impede the way of life of the universe. However, in view of the social reality of Korea, I think the possibility of [second option] is rich. But the important point is that both embryos and fetuses are living things. Thus, the discussion about abortion is, after all, a matter of being in line with the viewpoint of respect for life.
