Abstract
Today, most countries have established and applied the social security system on an institutional basis to guarantee their citizens' right to live healthy and to provide the public with necessary health care services. However, increasing life expectancy, slowing economic growth, and increasing medical expenses have placed financial limitations on the operation of the social health safety net, thus, raised the question of whether the continuation of the current social security system as a universal public good is durable and/or whether there are other conditions that need to be considered in conjunction with the state's social security obligations. In this regard, foreign countries have discussed to have individuals’lifestyles, health behaviors, and healthcare compliance as a influencial factor for the use of social security systems or a favorable or adverse conditions of determining the extent of social security benefits. This paper introduced the pros and cons of this issue and examined how foreign laws such as Social Code Book V (Sozialgesetzbuch, Germany), and Standard Concerning Implementation Special Health Examination and Special Public Health Guidance(also known as Metabo Law, Japan) define individual's health-related lifestyle, behavior and healthcare compliance as a condition of the use and benefits of the social security system. Lastly, this paper discussed the possibility of adopting foreign countries’precedents in Korea’s social security system as well as how to apply lessons learned from foreign laws to domestic health-related laws. It is hoped that the thoughts and insights drawn by this paper will provide insights on readjustment and a search for sustainable directions of Korea’s general health social security system in the future.
