Abstract
This paper attempted to explore the possible direction of juvenile justice policy that is more consistent with criminal responsibility. Article 9 of the Criminal Law does not deny the actual criminal responsibility of juveniles, but rather does not ‘protect’ juveniles as it is understood in that the Juvenile Act expands the scope of criminal sanctions. However, such misunderstandings and criticism persist because the current juvenile justice policy is not functioning properly in accordance with the purpose of the Juvenile Act. Juvenile Justice means that juveniles grow into a responsible member of a social community by clearly recognizing the meaning of the actions one has committed and seeking to recover from the damage. For that, this paper highlighted some policies that realize restorative judicial ideology, such as the Recommendation of Compromise, the victim’s procedural right to participate in criminal procedures and Japan’s system for conveying the victim’s feelings.
