Abstract
Even if the Online Access Act(OZG) can no longer be implemented by the end of 2022, the digital transformation of public administration is progressing unstoppably - recently also under the maxim “Digital First”. Electronic administrative services should no longer be an additional offer, but become the rule. Based on this, the next step towards a digital state could be called “Digital Only”. However, a partial obligation to use E-Government could violate german constitution or the constitutions of the federal states - provided they protect a “Right to Analog Access”. This paper first examines whether the reform possibilities of digital administration are infinite, and then examines the permissibility in the fundamental right of “Digital Only” in public administration. Here, I will focus in particular on the multidimensional system of the European Union(EU), the “Right to Analog Access” in the German Constitution(GG), and the “Right to Analog Access” in the German State Constitution. It is said that even the “Right to Analog Access” cannot counter to the digital administrative transition of these “Digital Only” services in accordance with the German federal and state e-government laws. The German Constitution and state constitutions do not provide for a general right of defense against digital administration. In the absence of a gap in the protection of fundamental rights, there would be no constitutional need for this. Such discussions in the European Union and Germany are expected to have great implications for digital administration-related legislative policies established by the Digital Government Bureau of the Ministry of Public Administration and Security based on the e-Government Act, especially in the digital platform government of Korea in the future.
