Abstract
his study focuses on the dominium theories of middle age in the 13th century. The opportunity to understand the private individual as the subject of ownership-dominium was created in the dispute on apostolic poverty and the struggle between papacy and imperium/regnums. In particular, it occurred during the period when secular monarchs strengthened their sovereignty against the pope as a universal emperor. John of Paris provided the theoretical foundation of the former, Giles of Rome did the latter. According to Giles, the Pope is spiritual and universal, whereas the secular monarch is physical and individual. But because the spiritual is superior to the physical, the pope must rule the secular monarchy. The actual possession of property can only be legally owned through the approval of the church. Only through baptism can a actual possessor become a legal owner. Therefore, a person who is not baptized or excommunicated can not be a legal owner. Giles saw that the pope has the dominion of secular. Pope’s dominium is a concept that includes judicial jurisdiction as universal dominion. In addition, Giles argued that the dominion of the pope was transcendent of the positive law. John, on the other hand, was influenced by Aristotle and Aquinas and understood secular nations and ownership as natural law. Based on this view, he distinguished the political community from the church. The state is indispensable for good life because it contributes to moral justice. It is not a mere material reality. The Pope is not the Vicar of Christ, but the successor of human Peter. His authority derives from the faithful. In this reason, the authority of the pope is limited to as an administrator of sacrament and church property. The ownership of secular property lies with the laymen. The external goods are acquired by individual persons through their art, labor, or their own industry. Each persons exercise right and true dominium over such goods. The secular monarch, on the other hand, has the right to jurisdiction(iurisdicto). The ruler must establish a stable system in which each individual's ownership is recognized. By dividing th concept of dominium into ownership and jurisdiction, John used the subject of subjective ownership as the subject of secular monarchy. John's theory of ownership influenced Locke's theory of civil government in the 17th century.
