2014년 1월 17일 「측량·수로조사 및 지적에 관한 법률」 시행령 제83조 개정으로 철도건설법에 따른 철도건설사업 및 도로법에 따른 도로건설 사업이 토지개발사업 범위에 포함되어 사업이 완료된 부지는 지적확정측량 대상이 되었으며 이에 대한 구체적인 측량범위와 방법 및 절차가 필요하다. 따라서 본 연구에서는 철도건설사업에 의한 철도부지 범위와 도로건설사업에 의한 도로부지 범위를 각 관련법률에 근거하여 세부적으로 분석하여 철도부지와 도로부지의 지적확정측량 범위를 정의하였다. 또한 기존 지적확정측량방법과 동일하게 적용하였을 때 발생되는 문제점 및 개선방안 등을 정립한 다음 철도편입부지와 도로편입부지에 대한 지적확정측량 방향을 제시하였다.
Abstract
To decide cadastral confirmation surveying range about roads and railway land which were newly included accordance with amendment of Act on Land Survey, Waterway Survey and Cadastral Record(ALSWCR), range of road construction site and range of railway land by the railway construction were analysed in detail based on each laws to define rang of cadastral confirmation surveying range about roads and railway land. Newly defined Cadastral confirmation surveying range about roads and railway land being newly incorporated to ALSWCR enforcement ordinance No. 83 and scope of land development projects have materialized with more realistic. In this study, after establishing to perform cadastral confirmation surveying about roads and railway land with being include how to compose control points, face of slop boundry determination, problems and improvement in accordance with applying method of existing cadastral confirmation surveying, new cadastral confirmation surveying guideline was suggested
