국립대학평의원회에 아테네 직접민주주의와 파리코뮌의 원리는 적용가능한가?

개정된 고등교육법 제19조의2(대학평의원회의 설치 등)에 대해 교수 및 교수단체가 문제점을 지적하고, 이의 재개정 서명운동에 돌입함으로써 대학 사회에 파장을불러일으키고 있다. 제19조의2 조항은 그동안 국립대학에서 자율적으로 운영되어왔던 대학평의원회를 법적 필수기구로 규정한다. 하지만 이 조항은 기존 대학평의원회의 기능과 권한을 상당히 축소시켜, 대학평의원회가 대학자치 기구로서 대학총장과 집행부를 견제하기에는 상당한 한계를 노출하고 있다. 본 연구는 국립대학 평의원회의 운영방향에 대해 직접민주주의와 파리코뮌의 원리가 적용 가능한지를 탐색하고자 한다. 파리코뮌은 인민주권에 의한 인민과 노동자 중심의 자치정부이며, 인민주권의 주체는 인민이다. 이에 따라 본 연구는‘대학자치 기구인 대학평의원회의 주체와 중심은 누구인가?’라는 질문을 던진다. 이를 위해본 연구는 21개 국립대학 대학평의원회의 설문조사 결과와 아테네 직접민주주의와파리코뮌의 원리를 바탕으로 대학평의원회 운영방향에 대한 이의 적용 가능성을논의할 것이다.
Abstract
Professors and faculty organizations are pointing out the problems of Article 19-2 of the amended Higher Education Act, and they are starting a campaign for its revision. The Act stipulates that the university council, which has been operating autonomously at national universities, is a mandatory legal institution. However, the article significantly reduces the functions and powers of the existing university council which, as an autonomous body, has considerable limits on its ability to check the power of the president and executive departments of the national university. This paper aims to seek the desirable direction for the university council by applying to it the direct democracy of Athens and the principle of the Paris Commune. The Commune embodied the autonomous government of the people and workers, and was ruled by the people. This paper will propose that the direction of the university council be based on the results of the questionnaires of 21 national university councils, and the aforementioned principles of direct democracy.
