Abstract

This paper explores the law of Athenian Adultery and argumentations in Lysias’s the first speech “Killing of Eratosthenes”. It is a speech of defense written by Lysias for Euphiletos who is accused of killing Eratosthenes, after he supposedly caught him committing adultery with his wife. Euphiletos's defense is that his murder of Eratosthenes was a justifiable homicide and therefore not punishable. The prosecution, however, had apparently argued that the murder of Eratosthenes was premeditated. I will argue that Lysias uses unusually argumentations: (1) the murder was not premeditated by stressing Euphiletos' lack of preparationon, but it was the legal penalty for “the men who do such things” according to Athenian law; (2) so it was not the act of homicide, but the act of justice to change the subject matter to this case and to focus the attention of the jury on the question that is before them; and (3) it was not premeditated, since he had a friend around for dinner that night but had not kept him around to help within the narrative and argumentative speeches.
