Abstract

The determination of whether welfare points constitute earned income under the Income Tax Act should be interpreted based on the legislative intent of the tax law and its inherent principles, rather than the principles of labor law concerning the nature of wages or the social security principles of labor welfare. In this regard, earned income under the Income Tax Act should be distinguished from business income and taxable gifts. It is sufficient for there to be a certain correlation with labor, without requiring a strict proportional relationship as in the case of wages. Therefore, earned income can be interpreted as any form of compensation, goods, or equivalent benefits received from another party in connection with the provision of dependent labor under an employment contract or a similar relationship. Consequently, the allocation of welfare points itself should be regarded as the provision of additional compensation. On the other hand, the tax authorities’ decision not to tax welfare points granted under the customized welfare system for public officials, while taxing welfare points granted under the flexible benefit plan based on private employment relationships, does not constitute an essential discriminatory treatment, as the two are not directly comparable. Even if a disparity exists, the differential treatment is justified by rational reasons, and thus, it does not violate the principle of tax egalitarianism. Moreover, it is questionable whether such claims even fall within the scope of applying the tax egalitarianism principle. Given the conflicting lower court rulings on whether welfare points constitute earned income, this ruling provides a desirable authoritative interpretation of the issue.
