초록

시노달리타스를 이루어야 하는 교회가 교회법과 만나면서 그 실현에 벽을 체험할 수도 있다. 하지만 교회법은 시노달리타스를 배태한 제2차 바티칸 공의회의 완성된 문서라고 할 수 있기에 교회법을 어떤 관점에서 바라보고 무엇을 강조하는가에 따라 교회법이시노달리타스를 성취할 수 있는 둘도 없는 수단이 될 수 있다. 본 연구는 이러한 취지에서 ‘전문성’, ‘객관성’, ‘능동성’이라는 세 가지 주제를 통해 교회법을 살펴 보고 시노달리타스를 향하는 관점과 적용 방법을 제시하고자 하였다. 먼저 전문성이라는 주제 안에서 ‘자문과 동의’라는 제도의 특징을 다루고 이어 ‘대리제도’가 갖는 시노달리타스의 특징을 살펴 보았다. 마지막으로 ‘참여의 원리’에 기반을둔 교회법 규정들을 조명하면서 시노달리타스로 향하는 길을 제시하였다. 둘째 객관성이라는 주제에서 통치의 ‘수직적 구조’와 교회 공동체의 ‘수평적 구조’ 및교회법 전반에 중심 원리로 스며든 ‘형평성’ 안에서 시노달리타스를 위한 관계를 연구하였다. 수직적 구조의 통치 체제가 객관성을 유지하면 시노달리타스의 토대인 신뢰를 조성할 수 있다는 것을 확인하였다. 수평적 구조의 객관성은 그 자체로 올바른 통치 실현이 되고 절차적 시노달리타스를 증명한다. 또한 형평성을 객관적으로 적용하면 시노달리타스뿐만 아니라 통치의 전문성도 살아난다는 것을 확인할 수 있었다. 마지막 주제로 능동성을 다루었다. 전문성과 객관성이 그리스도교 신자의 능동적 교회참여와 연관되고 이와 더불어 교회 권위를 통한 이 능동성을 위한 노력도 필요하다는 것이 확인된다. 이는 교회법에 그리스도교 신자들의 능동성을 실현하기 위한 조항들을 적용하는 문제가 신자들에게도 책임이 있지만, 교회 지도자의 의지에 크게 좌우된다는 것도 확인할 수 있기 때문이다. 본 연구는 교회법과 시노달리타스가 조화를 이루는 관점에서 통치 기능의 보완을 위해 중요한 세 가지 주제(전문성, 객관성, 능동성)를 연구하였고 각각의 주제와 연관된 교회법 조항들이 시노달리타스를 향하는 상호 연관성도 확인하면서 이들을 통한 사랑의 열매를 맺는 길을 제시하였다.

Abstract

Churches seeking to fulfill Synodality may experience barriers to its realization when they encounter canon law. However, since canon law is the finished product of the Second Vatican Council, it can be the perfect vehicle for achieving Synodality, depending on how it is viewed and what it emphasizes. To this end, this study examines canon law through the three themes of ‘professionalism’, ‘objectivity’, and ‘proactivity’ to provide a perspective and application toward Synodality. First, it addressed the characterization of the institution of ‘consultation and consent’ within the theme of professionalism, followed by the characterization of synodality as a system of representation. Finally, the path to synodality was laid out by highlighting canon law regulations based on the principle of participation. Second, under the theme of objectivity, the relationship for the synodality was studied within the ‘vertical structure’ of governance, the ‘horizontal structure’ of the church community, and the ‘equity’ that permeated as a central principle throughout canon law. I have seen that when a vertically structured governance system maintains objectivity, it can foster trust, which is the foundation of Synodality. Objectivity in the horizontal structure is itself a realization of good governance and demonstrates procedural synodality. In addition, it was confirmed that applying equity objectively improves not only synodalitas but also governance professionalism. The final theme is proactivity. It is affirmed that professionalism and objectivity are associated with active participation in the church by the Christian faithful, and that this active participation is supported by church authority. This is because we can see that the problem of applying provisions in canon law to realize the activism of Christian faithful is not only the responsibility of the Christian faithful, but also largely depends on the will of church leaders. This study examined three themes (professionalism, objectivity, and proactivity) that are important for the complementarity of the governing function from the perspective of the harmonization of canon law and the Synodality. It also identified the interrelatedness of the canon law provisions related to each of these themes toward the Synodality, and suggested ways in which they can be used to produce the fruits of love.
