Abstract

This study examines the transformation of Brazil’s environmental discourse and the emerging movement toward the legal institutionalization of the Rights of Nature. Drawing upon constitutional, legislative, and judicial developments, it explores how Brazil has moved from an anthropocentric model of environmental protection toward an incipient form of ecological constitutionalism. The analysis reveals that Article 225 of the 1988 Federal Constitution, although centered on the human right to a healthy environment, has gradually been reinterpreted to encompass the intrinsic value of ecosystems. Through the proliferation of municipal charters recognizing nature’s legal personality and key judicial precedents such as ADI 4983 (2016) and the 2005 STJ ruling on animal rights, Brazil has begun to articulate a new legal paradigm that situates environmental protection within a broader framework of social and ecological justice. Yet, the study also identifies persistent structural limitations: the lack of constitutional recognition of nature’s rights, uneven enforcement of environmental norms, and limited participation of Indigenous and Afro-Brazilian communities in policy making. To address these challenges, it proposes four directions for reform: constitutional codification of the Rights of Nature, institutional collaboration with traditional communities, strengthening of enforcement mechanisms, and expansion of environmental education and international cooperation. Ultimately, the Brazilian experience suggests that the Rights of Nature discourse should be understood not merely as a legal innovation but as a decolonial effort to restore cultural roots and to redefine law as an ethical language of coexistence among all forms of life.
