한국의 차별금지법 제정 추진과 국제인권규범의 시사점

초록

본 논문은 차별금지법안의 입법문제를 둘러싼 한국 사회의 논쟁들 속에서 중요 쟁점은무엇인지 살펴보았다. 차별금지법안은 장애인에 대한 차별금지 등 다양한 차별금지사유들을 종합적으로 다루고 있지만 실제 입법과정에서는 결국 성소수자들에 대한차별금지문제가 논쟁의 중심에 있는 것으로 이해하였다. 이와 관련하여, 유엔에서 그동안 차별방지 목적으로 체결된 주요 국제인권협약들을 검토하였다. 그 결과, 인종차별등 7개 주요 인권 하위분야와 달리 성소수자들을 위한 국제협약이 아직 존재하지 않는다는 사실에 주목한다. 대신, 성소수자들에 대한 차별금지를 목적으로 발표된 욕야카르타원칙과 욕야카르타 원칙 플러스 10이 존재하는데 이는 민간전문가들이 모여 작성한것으로서 다른 국제협약들보다 그 법적인 권위는 약하다고 할 수 있다. 같은 맥락에서그동안 시도된 차별금지법안의 결정판으로 성소수자들에 대한 차별금지를 포함하는기본법으로서 새로운 차별금지법안이 현재 한국 국회에 계류 중이지만 그에 대한 반대의견이 높은 상태이다. 따라서 본 논문은 이 차별금지법안이 국회에서 성공적으로 입법화되기 위해서는 성소수자들에 관한 좀 더 객관적인 정보들을 폭넓게 공유함으로써 그반대론자들에 대한 설득작업이 좀 더 수행될 필요가 있는 것으로 보았다.

Abstract

This article delves into the background and prospect for the controversy with regard to the legislation efforts against discrimination in the National Assembly of Republic of Korea. While the draft bill against discrimination deals with a variety of discriminitory fields of human rights including people with disability, the main focus of the controversy centers on the equal treatment of the people of sexual orientation, gender identity, and gender expression. As a way of exploring the obstacles to the legislation of the draft bill, this article reviews the existing international conventions against discrimination within the UN human rights mechanism. Interestingly, there is no international convention on the protection of the people with sexual orientation, gender identity, and gender expression whereas there exist Yokyakarta Principles and Yokyakarta Principles Plus Ten formulated by civil society experts and activists as a human rights instrument for the people of sexual orientation, gender identity, gender express and sexual characteristics. In a similar vein, the Korean society continued to fail in legislating a draft bill on the protection of people of sexual minority. Seen in this way, this article argues that it is necessary for the pros and cons for the draft bill against discrimination to get together and to engage in serious dialogues so that they can reach deep mutual understanding of the issue in place.
