‘기본소득’이란 모든 사람에게 아무런 조건 없이 최저한의 소득을 보장하는 것으로 현재의 사회보장제도와 근본적으로 다르다. 즉 모든 사람에게 노동, 결혼, 성별 등의 조건을 전혀 묻지 않고 부여하는 소득보장구상이다. 이러한 기본소득이 구상된 이유는, 종래 사회보장제도의 전제였던 노동과 가족의 구조, 즉 완전고용 하에서 남성이 정규직으로 노동하여 임금을 받고, 전업주부인 여성이 가정에서 무상노동을 한다는 구조가 붕괴되고 있으며, 특히 기업중심사회에서 사회보장제도가 제대로 기능하지 못하고 있다는 점에 있다. 이 논문은 현재의 사회보장제도가 갖는 문제점을 극복하기 위해 제안된 기본소득을 그 역사적 기원으로부터 브라질에서 채택된 최초의 기본소득법까지의 연혁을 개관하고, 그와 유사한 마이너스 소득세, 참가소득, 사회배당을 검토한 뒤, 기본소득이 갖는 문제점을 극복하기 위해 제안된 고르의 노동시간단축과 기본소득의 결합, 사회적 배제와 빈곤 및 워크페어를 살펴보고 우리의 헌법을 비롯한 사회보장법과 노동법 차원의 논의에서, 특히 한국에서도 최근 심각하게 문제되고 있는 비정규직의 보호와 사회문화나 예술과 학문 분야 종사자의 기초생활을 보장하기 위한 최저한의 소득을 보장한다는 기본소득의 취지와 내용을 검토한다.
Abstract
Basic Income means securing minimum income for every person unconditionally. We have seen the historical origins of Basic Income from the thoughts of Thomas Paine and Thomas Spencer, and the Speenhamland of England to the legislation of Basic Income of Brazil. And we have compared it with Negative Income Tax, Social dividend and Participation Income. Also, we have scrutinized Andre Gorz's Basic Income plus working time shortening, Social Exclusion and Poverty, and Workfare. Those have been debated primarily in England and Europe, but it is also necessary to discuss them in Korea. There are some problems in adapting Basic Income to Korea, but it is at least worth discussing Constitution, Social Security Law and Labor Law. Especially, because recently we have many problems on irregular workers and culture workers, Basic Income cannot be ignored in Korea. The right to a life worthy of human beings in Article 34 of Korean Constitution guarantees the right to Basic Income. Therefore we should argue the active acception of Basic Income concerning ecology and several human values. In such harmony, the Korean development of Basic Income to combine labour and welfare is necessary.
