2010년부터 노동현장에서 발생하는 용역경비에 의한 폭력현상은 이전과는 달리 자본에 의해 기획된 탄압의 양상을 보이고 있다. 용역경비를 동원한 자본의 폭력은 노동자의 쟁의에 대한 방어적 수준을 넘어선 공격적 양상을 띠며, 특히 이는 2010년부터 노동조합의 세력이 강한 사업장에서 민주노조를 무너뜨리기 위한 방식으로 채택되어 실질적인 노조파괴에까지 이르고 있다. 용역경비를 동원한 자본의 폭력은 노사대립의 균형을 무너뜨리고 노사관계를 비정상적인 것으로 고착시키며, 이는 노동자에게는 곧 권리의 박탈을 의미한다. 이 글에서는 용역경비투입이 벌어진 사업장 사례를 검토하고, 이를 통해 용역폭력이 노사관계에 미치는 영향을 살펴보았다. 아울러 노동현장에서 용역폭력을 규제하고 노동자 권리를 보장하기 위해 필요한 가이드라인을 제시하였다.
Abstract
Acts of violence performed by the guard services in the field of labor since the amendment of labor law in 2010, unlike previous years, seem to be an elaborately planned oppression of the capital. Large-scale private security agents use violence very offensively, exceeding the appropriate, defensive level, and thereby are threatening to substantially neutralize the labor unions. The hegemony of industrial relations is fully tilted towards the capital, making workplaces the blind spots of human rights. Therefore, the violence of private security agents as well as the capital’s resort to violence should be banned. This article will look over the effects that guard service violence has on the labor-management relations, based on the actual cases in which guard services have been committed in the workplaces recently. In addition, it will suggest the social guidelines to regulate private security violence in order to protect labor rights.
