Abstract
The guiding principle of compulsory purchase of interests in land in South Korea is that of fairness. The owner has the right to be put in the same position as if his land had not been taken from him. Since Korean War, the compulsory purchase of land has taken place a lot for the use of land to build US military bases in South Korea. With the “Agreement between the Republic of Korea and the United States of America for the Land Partnership Plan” given effect on October 31, 2002, in many instances land acquired by compulsion subsequently becomes surplus to the requirements of the acquiring authority. The principle of fairness requires the Ministry of Defence to offer back to the former owners or their successors, any land previously so acquired by, or under the threat of, compulsory purchase but no longer required.
