아동의 출생등록 제도와 국가의 아동안전 보장의무 - 영국의 출생통보 제도를 중심으로 -

본고는 아동의 생명과 신체에 대한 항상적 보호 상태로서의 ‘안전’이라는 헌법적 법익의 중요성을 강조하고자 하였고, 국가의 아동안전 보장의무의 이행은 아동의 출생등록 제도에서 출발한다고 보았다. 그리고 우리나라의 현행법제와 같이 아동의 출생등록을 일정한 신고의무자의 자발적 신고에만 의존할 경우, 국가의 아동의 출생사실 확인 과정에서 필연적으로 공백이 발생할 수밖에 없으며, 이 경우 아동의 헌법상 기본권주체로서의 지위 획득이 사실상 불가능해져 아동의 기본권 침해 가능성이 높아질 수 있으므로 현행법제가 국가의 아동안전 보장의무의 이행의 관점에서 불충분하다고 보았다. 본고는 국가가 아동의 출생 관련 사항을 선제적으로 수집하는 것은 아동의 기본권의 실질적 보장 및 실현을 위해 국가가 아동안전 보장의무의 일환으로서 담당하여야 할 핵심적인 의무라고 판단하였으며, 이를 시행하고 있는 입법례로 영국의 출생통보 제도를 검토해 보았다. 영국의 경우, 아동의 출생과 관련 있는 의료기관 등이 관련 당국에 그 사실에 대한 일차적인 통보의무를 부담한다. 이에 따라 아동의 출생사실이 그 즉시 당국에 통보되어 아동이 국가의 인계통계 서비스(Personal Demographics Service)에 기록됨은 물론, 아동에 대한 국민보건서비스(Natinal Health Service) 번호의 부여, 필수적인 의료서비스 제공 등이 가능해짐으로써 아동의 생명과 신체에 대한 선제적 보호가 이루어진다. 그리고 의료기관 등에 의한 출생통보와는 별도로, 부모 등 일정한 자는 아동 출생 관련 정보를 아동이 출생한 지역의 등록관에게 제공할 의무를 부담한다. 그리고 등록관은 의료기관 등에서 제공된 아동의 출생사실에 대한 정보를 기반으로 하여, 부모 등이 아동과 관련한 출생등록 정보 제공을 제대로 하였는지에 대하여 검토하여 아동의 출생등록이 누락되거나 지연되는 경우를 최대한 방지하고 있다.
Abstract
This study seeks to highlight the constitutional interest of “safety” as a constant state of protection over the life and body of children and posits that the performance of a state’s obligation to ensure children’s safety begins with a birth registration system. In states where the childbirth registration system relies solely on voluntary registration by an authorized person including a parent, such as the one currently in effect in South Korea, gaps in a state’s confirmation process of children’s birth are inevitable. In such cases, it becomes practically impossible for a child to gain status as a holder of basic constitutional rights, heightening the risk of infringement of their basic rights. Thus, in light of a state’s obligation to ensure children’s safety, the law currently in effect is insufficient. This study posits that it is a key obligation of a state to preemptively collect information related to the birth of children as part of its obligation to protect their safety, to effectively ensure and realize children’s basic rights. Furthermore, it examines the birth notification system in England and Wales, which has adopted the abovementioned framework. In England and Wales, any medical institution and others associated with the birth of a child bear the primary obligation to notify the relevant authority. The birth is then immediately registered with the Personal Demographics Service run by the state. At the same time, it becomes possible to assign a National Health Service number and provide essential medical services to the child, thereby providing preemptive protection to the child’s life and body. Apart from medical institutions’ obligation to notify births, certain persons, including parents, have the obligation to provide information related to a childbirth to the registrar of the region where the child was born. Then, the registrar reviews whether the information was properly provided based on the childbirth data supplied by medical institutions, thus preventing any omissions or delays in a child’s birth registration.
