영국 평등인권위원회의 차별금지 직무와 그 시사점

초록

세계인권선언과 다수의 국제인권조약들은 차별받지 않을 권리를 규정하고 있고, 「대한민국헌법」도 제11조 제1항에서 차별받지 않을 권리를 명확히 규정하고 있다. 국내적으로 차별금지에 관한 여러 개별 법률이 존재하지만, 아직 일반적 차별금지법 제정에는 이르지 못하고 있다. 일반적 차별금지법이 존재하지 않는 상황에서 차별에 관하여 가장 포괄적인 업무를 수행하는 기관은 「국가인권위원회법」에 따라 2001년 11월에 설립된 국가인권위원회이다. 차별금지에 관한 국가인권위원회의 위상과 그 업무의 중요성을 염두에 두면서, 국외의 다른 차별시정기구의 직무를 분석하여 비교 검토하는 것은 차별시정기구로서의 국가인권위원회의 역할 수행을 보완하거나 강화시킬 방안을 모색하는 측면에서 의미 있는 작업이라고 생각한다. 이러한 측면에서 우리 국가인권위원회와 유사하게 ‘국가인권기구의 지위에 관한 원칙’에 따른 국가인권기구이자 동시에 차별시정기구인 영국의 ‘평등인권위원회’는 적절한 검토 대상이다. 우리나라의 「국가인권위원회법」에 대응되는 영국의 「2006년 평등법」은 영국 평등인권위원회가 차별금지와 관련된 직무를 충실히 수행할 수 있도록 일반권한과 집행권한을 부여하고 있고, 평등인권위원회는 각각의 상황에 있어서 부여된 권한들 중 가장 효과적인 수단을 선택하여 행사해오고 있다. 영국 평등인권위원회의 차별금지와 관련된 직무를 「2006년 평등법」에 규정된 일반권한과 집행권한의 세부 내용으로 중심으로 살펴본 다음 그 시사점을 확인해보고자 한다.

Abstract

Article 11 paragraph 1 of the Constitution of the Republic of Korea, in common with the Universal Declaration of Human Rights and a number of other international human rights instruments, explicitly provides principles of equality and non-discrimination. In Korea, several domestic laws regulating the principle of non-discrimination exist. However, a comprehensive anti-discrimination legislation has not yet been adopted. Meanwhile, the National Human Rights Commission of Korea (NHRCK) was established in November 2001 under the “National Human Rights Commission Act” and carries out comprehensive duties of anti-discrimination. When the NHRCK’s status and its responsibilities have a significant meaning in promoting non-discrimination in Korea, to review and analyse how other equality organizations abroad function would give us a valuable opportunity to find a way to improve or enhance the Commission’s functionality. From this perspective, the Equality and Human Rights Commission (EHRC) in the UK, comparable to the NHRCK, is worth to notice as a equality organization and national human rights institution complying with the “Principles relating to the Status of National Institutions.” Corresponding to the National Human Rights Commission Act in Korea, the “Equality Act 2006” in the UK enables the EHRC to perform its duties of anti-discrimination by granting general and enforcement powers. The EHRC selects the most effective measures and enforces its authority on a case-by-case basis. This paper is intended to review in detail the EHRC’s general powers and enforcement powers provided in the Equality Act 2006 and derive some meaningful implications.
