유럽사회권기둥과 그 실행계획은 강력한 사회적 유럽을 향한 유럽위원회뿐만 아니라 유럽연합과 회원국의 약속이다. 하지만 유럽연합과 회원국 정책에 대한 실행계획의 영향력을 감안할 때, 그 한계는 명확히 지적되어야 한다. 유럽사회권기둥과 그 실행계획은 노동 및 생활 조건의 전반적인 개선보다는 노동 시장에 대해서만 다루고 있으며, 사회적 점수판의 중요성을 강조함에도 불구하고 법적 구속력의 부재라는 문제를 안고 있다. 예를 들어 실행계획은 여전히 유럽사회권기둥이 제시한 정책 목표들을 달성할 수 있는 혁신적인 구현 수단을 부여받지 못하고 있다. 이러한 측면에서 유럽연합의 사회정책인 유럽사회권기둥과 그 실행계획은 ‘소극적 통합에 이바지하는 규제적 정책’이라고 평가될 수 있다.
Abstract
The European Pillar of Social Rights and its Action Plan are a commitment of the European Commission as well as the European Union(EU) and its Member States towards a strong Social Europe. However, given their influence on EU and Member State policies, their limitations should be clearly pointed out. The European Pillar of Social Rights and its Action Plan only address the labor market rather than the overall improvement of working and living conditions, and despite emphasizing the importance of the Social Scoreboard, it suffers from the lack of legally binding force. For example, the Action Plan is still not endowed with innovative means of implementation to achieve the policy objectives set out by the European Pillar of Social Rights. In this respect, the European Pillar of Social Rights and its Action Plan, as a social policy of the European Union, can be characterized as a ‘regulatory policy contributing to passive integration’.
