이 글은 마스트리히트 이후 특히 2000년대를 중심으로 사회적 유럽의 전개과정과 주요 성과를 검토한다. 그동안 사회적 유럽의 건설에 대해서는 비관적인 전망과 평가가 주를 이루어왔다. 그러나 비관론자들의 전망과 달리, 이 글은 사회정책 입법과 사회적 대화의 양 측면에서 사회적 유럽이 상당히 진척되어 왔다고 주장한다. 우선 유럽연합의 사회정책권한이 마스트리히트에서 크게 확장됐다. 그 후 정책권한 자체는 크게 진전되지 않았지만, 사회정책 입법활동은 2000년대 들어서도 꾸준히 지속되었고 특히 노동조건과 종업원 참여 부분에서 괄목할만한 진전이 있었다. 사회적 대화에서는 2000년대 들어서 자율적 대화가 증가하였고, 사회적 동반자들 사이의 합의사항을 법으로 집행하기보다 자율적으로 실행하는 경우가 많아졌다. 법적 구속력을 수반하는 합의의 비중이 상대적으로 줄었지만, 그만큼 사회적 대화의 범위와 종류가 다양해지고 노사 간 자율적 대화공간이 확대되었다. 비관론자들의 예상과 달리 유럽 차원의 사회적 공간이 확대되고 있는 것이다. 이 글은 구체적 성과들을 검토함으로써 2000년대 들어 사회적 유럽의 건설이 보다 자율적인 방향으로 경도되고 있지만, 그것이 사회적 유럽의 건설에 대해 어두운 평가와 전망을 내릴만한 이유는 아니라고 주장한다. ‘열린 조정방식(OMC)’이 전반적으로 확대되는 일반적인 경향에 따라 사회적 유럽의 건설에서도 자율적 방식이 증가하고 있지만, 입법과 대화의 양 측면에서 유럽의 사회적 공간은 상당히 진척되고 있다.
Abstract
This paper examines the historical evolution of the ‘social Europe’ and assesses its major accomplishments since the social policy reforms in the Maastricht Treaty, especially during the first decade of the 21st century. Pessimism, rather than optimism, has been dominant with regard to the prospects of building a social Europe since “Europe” was relaunched by the Single European Act in the mid-1980s. Contrary to the dominant pessimistic views, I present in this paper that there have been considerable progresses in constructing a social Europe in the areas of legislation as well as social dialogue. Despite the limited expansion of the European Union’s competences in social policy areas since the Maastricht Treaty which introduced a major expansion of European-level competences in social policy, there has been a steady accumulation of legal activities at European level in the 2000s. In particular, working conditions and employee participations are the two issues where European Union has demonstrated its legislative capabilities. In the European social dialogue an autonomous pattern of social dialogue has increased in the 2000s. Social partners increasingly carry out their agreements autonomously instead of relying on the legal instruments of implementation. Albeit less agreements with legally binding forces than before, though, the European social dialogue has instead diversified its scope and forms, and the autonomous space of the European social partners has considerably expanded. Hence the growth of a social space at the European level contrary to the pessimistic views.
