소규모 무노조 사업장의 고용관계 정책대안에 관한 탐색적 연구

초록

우리나라 노동조합 조직률은 2009년말 기준으로 10.1%이며 조합원수는 166만명 수준이다. 전체 조직대상 근로자중 89.7%는 비조합원이며, 사업장 기준으로는 90%가 넘는 사업장에 노조가 결성되어 있지 않다. 본 연구는 이를 전제로 무노조 사업장의 고용관계에 대해 살펴보고 정책대안을 모색하는데 그 목적이 있다. 무노조 사업장 대부분은 100인 미만의 중소규모나 영세사업장이 대다수이며, 근로조건이나 근로자의 근로생활에 대한 만족도도 대단히 낮은 실정이다. 앞으로 노동조합 조직률이 급격히 높아질 가능성이 높지 않고, 소규모 사업장에서 근로자 대표기능이 활성화되기는 어려운 현실이다. 따라서 소규모 무노조 사업장을 중심으로 근로자의 권리가 보호될 수 있도록 노무관리지원을 강화하고, 노사협의회가 실질적인 노사협력의 효과를 발휘할 수 있도록 사업장을 노사협력 수준에 따라 유형화하여 단계별로 적절한 정책적 지원을 강화할 필요가 있다. 이와 함께 이러한 정책적 효과가 확산될 수 있도록 대기업과 중소기업의 상생협력이 활성화될 수 있는 제도적 기반을 조성하는 것도 중요한 과제이다. 앞으로 정부정책의 관점과 시각을 대기업 유노조 사업장의 경우는 노사자율교섭에 비중을 두어 스스로 갈등을 해소하도록 하고, 상대적으로 관심이 적었던 무노조 사업장에 대해 인력·재원 등 정부역량을 집중하는 방향으로 전환되어야 할 것으로 생각된다.

Abstract

Union density in Korea is 10.1% with 1.66 million unionized workers as of 2010. 89.9% of the employed do not hold union membership, and 90% of enterprises do not have unions in the first place. In this respect, this study will overview the current employment relations in non-union workplaces and explore ways for alternative policy options. Most of the nonunion workplaces are small and midium sized enterprises with less than 100 workers, and the level of workers' satisfaction in theses workplaces in terms of working life and labor condition is remarkably low. It is prominent that a rapid increase in the union density is unlikely, and workers' representation in small enterprises is likely to remain weak. Therefore, the “Government personnel management support program” should be strengthened so that the workers' rights can be protected in nonunion workplaces. In order to make the labor-management council by creating tangible cooperation results between labor and management, there should be targeted measures that select workplaces depending on their level of cooperation and design customized polices for each type of workplace. Also, new policies should be designed to promote closer cooperation between large conglomerates and SMEs. The government should take a two-faceted approach. For workplaces of large conglomerates that have unions, the government should promote self-regulation, encouraging the stakeholders to address conflicts on their own. Meanwhile, it should focus its resources including budget on small and medium sized nonunion workplaces.
