인천광역시 환경영향평가 조례 대상사업 확대 방안에 관한 연구: 건축물 및 정비사업을 중심으로

본 연구에서는 인천광역시 환경영향평가 조례의 실효성 강화를 위해 건축물과 정비사업을 중심으로 관련 자료를 분석하여 현행 제도의 한계와 지역 여건을 반영한 대상사업 확대 방안을 제시하였다. 「건축법」, 「도시 및 주거환경정비법」 등 관련 법령, 인천의 환경영향평가 현황(전략환경영향평가, 환경영향평가, 소규모환경영향평가, 시·도 조례에 의한 평가(이후 ‘조례평가’), 건축심의 등의 분석 결과, 연면적 100,000m2 이상 건축물은 연평균 약 2.7건, 사업면적 150,000~300,000m2 정비사업은 약 1.8건의 신규 평가수요가 발생할 것으로 예측되었다. 서울·부산 등은 이미 건축물·정비사업을 조례평가에 포함해 연평균 10여 건을 추진하고 있으며, 이를인천에 적용할 경우 약 4.5건의 추가 평가가 가능할 것으로 전망된다. 인천의 환경영향평가 사각지대 해소와 지역 맞춤형 평가체계를 구축을 위해서는 이와 더불어 조례 개정과 전문기관 위탁 등 제도적 기반 마련도 후속되어야 한다
Abstract
This study aims to improve the effectiveness of the Environmental Impact AssessmentOrdinance in Incheon Metropolitan City by proposing an expanded scope of target projects based oninstitutional limitations and local development conditions. Focusing on large buildings and urbanredevelopment projects, the analysis reviewed relevant legislation, Incheon’s current EIA system (SEA,EIA, SEIA, and ordinance-based EIA), and records of building permits and redevelopment activities. The results show that approximately 2.7 new annual assessments would arise from buildings with atotal floor area of 100,000 m2 or more, and about 1.8 cases from redevelopment projects of 150,000-300,000 m2. Major local governments such as Seoul and Busan already include these projects in theirordinance-based EIAs, conducting around ten assessments each year; applying similar criteria to Incheon would generate roughly 4.5 additional cases. To address assessment blind spots and establisha regionally tailored framework, Incheon must amend its ordinance and strengthen institutionalcapacity through specialized agency delegation and additional personnel. The study providesempirical evidence that incorporating buildings and redevelopment projects into ordinance-basedEIAs can enhance environmental governance and support sustainable urban development.
