한국정치의 사인화(私人化) 현상과 안으로서의 연성법(soft-law): 시민세력을 둘러싼 정치적 냉소주의, 촛불집회, 그리고 정치과제

정치적냉소주의는정치의사인화현상의원인이된다. 그리고이러한현상 은 사적 이익을 추구하는 정치권세력으로 인해 국내 시민세력의 성장이 제한 되는 결과로 이어진다. 따라서 국가는 이에 한 안으로서 정책 및 제도를 생산해야하는데, 정치의사인화현상은그과정에도악향을미친다는점에 서 기존의 시도와 다른 새로운 안을 필요로 하게 만든다. 문제를 해결하기 위해서는, 정책 및 제도의 원점인 규범 및 규칙에 따른 패러다임 차원의 변화 가필요하다. 시민세력에의해선출되는정치권세력을통제하기위해서는, 법 체계에서의수정을통해정치적소통불능현상을해결해야하기때문이다. 이 러한안이형성되지못한다면, 한국은시민세력의저항및불만을해소하지 못한 채로 정치발전의 측면에서 정체할 것이다. 한국사회의 발전은 시민세력 의 성장에 달려있다. 그리고 그 성장은 제도 및 정책의 발전을 통해 이루어질 수 있다. 작금의 촛불집회는 이에 따른 수정시도의 필요성을 시사한다. 따라 서한국은연성법적사고를수용및발전시켜나감으로써, 기존의정치권세력 의책임성회피와공공성확보실패의문제로인한정치의사인화현상을점진 적으로해소시켜나가야한다.
Abstract
The personalization of politics in Korea leads to a result that the development of civil groups is restricted by political parties what seeking private interests. Thus, Korea needs to analysis and make an alternative for minimizing the personaliztion of politics. Korea s social developments are depended on civil groups, however, institutions and policies for that are decided by political parties. So, the failure of political parties has been a reason what causes restrictions of civil groups and occurrences of various political problems. In this case, Korea should propose an alternative policy what is different from existing ways. The alternative should be flexible for accepting civil groups interest, make the repetitive feed-back for rectification. The approach of soft-law is a new tool for arguing this. The purpose of this article is what to argue an alternative through analysing merits of soft-law. Soft-law can be useful to make new alternatives on aspects of human rights, public diplomacy, and so on. Korea s candlelight rallies and its reactions of political parties on 2016-2017 can be cases what explain upcoming merits of softlaw.
