일본 방사능 오염수 방출의 법적 책임에 관한 고찰

2011년 4월 4일 일본은 방사능 오염수 1만1500 톤을 바다에 방출하였다. 문제는 이러한 일본의 행위가 우리나라를 포함한 주변국과 국제사회에 사전에 통보되지 않고 시행되었다는 것이며, 그보다 더 큰 문제는 향후 일본이 유사한 행위를 저지른다고 하더라고 이를 제지할 만한 구체적인 방법이 없다는 것이다. 일본의 방사능 오염수 방출과 관련해서는 우리정부 뿐만 아니라 학계에서도 해결방법을 찾고 있는데, 이에 적용할 수 있는 국제법으로는 유엔해양법협약, 런던협약 및 다수의 원자력안전 관련 국제협약 등이 있다. 이 논문에서는 이들 국제규범 중 1982년 유엔해양법협약을 중심으로 일본의 방사능 오염수 방출행위의 문제점을 지적하고, 재발방지를 위해서는 국제사회에서 이를 어떻게 처리해야하는지를 제안한다. 우리나라와 국제사회는 현존하는 국제규범을 근거로 일본의 진심어린 사과와 재발방지 약속을 받아 내야 할 것이며, 필요한 경우 지금까지의 손해배상책임도 물어야 할 것이다.
Abstract
On April 4th, 2011 Japan released 11,500 tons of radioactive waste into the sea, contaminating the water and neighboring countries. First, Japan taking action without prior notice to neighboring countries and the international community poses a problem with severe implications. A bigger issue is if and when similar events take place in the future, there is no concrete way to hold Japan accountable for her actions. The concern with this issue has Korean government and academia searching for viable solutions. This paper aims to point out the problems of the actions committed by Japan with support from applicable laws, such as UNCLOS, London convention and a number of international conventions related to nuclear safety. It also focuses on what needs to be done in order to prevent a recurrence of such events on the basis of existing international norms and how Korea and suggests how the international community must hold Japan liable for her actions.
