(Commission of Small Island States on Climate Change and International Law,
Abstract
At a time when the adverse effects of sea level rise are directly evident, the Commission of Small Island States on Climate Change and International Law (COSIS) in December 2022 requested the International Tribunal for the Law of the Sea of the advisory opinion to clarify State responsibility under the United Nations Convention on the Law of the Sea(UNCLOS). However, since UNCLOS does not explicitly state in its provisions about GHG emissions and climate change, which are causes of sea level rise, UNCLOS could not provide an affirmative answers on what binding international obligations as an element constitute the state responsibility and thus, what conducts ca breach them through the context of the Convention itself. However, Part 12 of the UNCLOS gives the parties a general obligation to protect the marine environment, and through this, the parties are obliged to regulate greenhouse gas emissions, which cause sea level rise. This obligations include due diligence which can be served as a basis for the UNCLOS referring to the UNFCCC and Paris Agreement which regulate climate change and GHGs emission along with Article 293 of the UNCLOS. While ITLOS can employ the general obligation to find international obligation of UNCLOS for sea-level rise, since the due diligence are assessed case-by-case depending on the conditions and circumstances of each country, more research should be carried out in order to establish state practice and standard of duty of care in due diligence in relation to UNFCCC and customary international law.
