Abstract
This article explains how the institutional context(legalization) of international negotiations influences their outcomes. I argue that the role that the World Trade Organization (WTO) can play for the settlement of United States-Japan Disputes. I test the argument in the case of the Japan-U.S. Automobile and Parts Trade Dispute, which has been among the most difficult sectors for governments to liberalize. The Japanese-American relationship is one of the world's most important bilateral relationships. In general, we believe that in the past Japan and the U.S. have placed too much emphasis in dispute settlement on bilateral government-to-government negotiation as a dispute settlement technique. In the 1980s the U.S. invoked Section 301 and declared unilateral sanctions against Japan, whose domestic auto parts market was allegedly closed, by raising tariffs on Japanese automobiles. But, the U.S. has brought a nullification and impairment (nonviolation) case in the WTO, has filed a request for a dispute settlement panel under the WTO General Agreement on Trade in Services (GATS), and has requested consultations with Japan on restrictive business practices. Both bilateral and multilateral rules and procedures will be analyzed for the purpose of providing the most appropriate means of dispute avoidance and dispute settlement in the context of Japanese-American economic relations, depending upon the context of the WTO disputes settlement procedures. Major focus will be upon the legalization of WTO effects on Japanese-American economic relations, and will include dispute settlement mechanisms and processes. Especially, I will discuss how preferences, policies, and institutions on the side of Japan and U.S. are related to GATT/WTO regime and evaluate the impact of the international system(legalization) upon domestic politics.
