Abstract

This study examines the prevalence of anti-competitive labor practices, such as wage-fixing and no-poach agreements, employed by firms within joint ventures or vertical supply relationships to prevent the loss of key personnel. It analyzes how these practices can distort competition within the labor market. Specifically, the study explores the potential for competition law to regulate platform operators who leverage their market dominance to impose unfavorable conditions on participants within their platforms or to hinder their movement to competing platforms. By adopting a competition law lens to analyze the status of platform workers, this study aims to provide a comprehensive analysis of the types and characteristics of anti-competitive conduct occurring within the labor market. Furthermore, it seeks to establish that the determination of platform workers' employment status, arising from unfair employment practices by platform operators, transcends mere labor law considerations. Instead, it represents a critical competition law issue with profound implications for market competition, efficiency, and consumer welfare. Ultimately, through competition law analysis of platform labor markets, this study aims to offer insights that can foster the harmonious development of both labor law and competition law.
