뉴욕시 도시계획 변경과정에서 공공과 민간의 협상에 관한 연구 - 컬럼비아대학교 확장개발사업과 실버컵 개발사업 사례를 중심으로 -

본 연구는 미국 뉴욕시의 도시계획 변경과정에서 협상에 대한 경험과 사례분석을 통해 최근 사전협상제도를 도입한 서울시를 위해 시사점을 도출하는 것을 목적으로 한다. 이를 위해 본 연구는 전반적인 문헌연구를 통해 일반적인 뉴욕시 도시계획과정의 체계와 협상의 역할, 참여주체의 권한 등을 살펴보고, 실제 사례분석을 통해 도시계획 변경과정에서 협상이라는 수단이 어떻게 활용되고, 이를 통해 공공성을 확보하고 있는지 구체적으로 분석하였다. 결론적으로, 서울시의 사전협상제도가 성공적으로 정착하기 위해서는 뉴욕시의 경험을 통해 본 것처럼 협상의 근거가 될 수 있는 객관적이고 합리적인 절차가 갖추어져야 하며, 협상의 결과물로서 양측의 의무를 강제할 수 있는 법적 수단이 갖추어져야 한다. 그러나 무엇보다 중요한 것은 협상 과정 속에서 해당 개발계획안을 파악하고 공공의 요구에 따른 대안과 공공기여방안 등을 합리적이고 논리적으로 제시할 수 있는 공공의 경험과 전문성이라고 판단된다.
Abstract
Seoul City has recently adopted the Pre-Negotiation Tool for rezoning, thereby trying to change the paradigm in the Korean urban planning system. It seeks to establish the partnership approach between the public and private sector, in which the private sector may initiate to rezone an existing underdeveloped site in return for providing public benefits. This paper seeks to suggest the schemes for Seoul City from the New York City’s experience regarding negotiation in the rezoning process, focusing on two case studies. The lessons from New York City are as follows. First, New York City has the official processes for public review including the Uniform Land Use Review Process and the Environmental Impact Statement, which function as a reasonable, objective basis for negotiation. Second, it has the effective legal tools to enforce the private sector’s agreements, such as ‘restrictive declaration’ and ‘community benefits agreement’, as well as the design guidelines of the zoning. Third, and the most important, this paper concludes that Seoul City needs the professional skills and experiences to maximize the public benefits from rezoning by analyzing proposed plans in negotiating with the private sector.
