We analyze the U.S. regulations on IPR-infringing imports, Section 337 of the Tariff Act of 1930. First, examining the border measure provisions of the WTO TRIPS Agreement, we discuss the development of Section 337 including a GATT dispute case. Then, we examine Section 337 investigation procedures and remedies. Investigation procedures include commencement of investigation, discovery, hearings, initial determination by an ALJ, ITC determination and President’s approval. In addition, the available remedies are limited exclusion, general exclusion, cease and desist order, and temporary relief.
