정비사업 조합설립추진위원회 단계의 소송현황 및 갈등요인 분석

Abstract

This study aims at suggesting solutions of reducing disputes among interest parties for the redevelopment projects by analyzing 31 suit cases and conflict causes related with the promotion committees out of 170 cases of administrative litigations which are completed at 25autonomous districts in Seoul from January, 2005 to March, 2011 for the redevelopment,reconstruction and new-town project which Seoul City has promoted. According to the study results,first, the lawsuits related with the promotion committee took 31 cases out of 170 administrative litigation cases(18.2%). And when classifying types of the reasons for filing litigations, they can be largely divided into 1) revocation of the authorization for promotion committees：14 cases(45.1%),2) affirmation of the invalidity of authorization for promotion committee：16 cases(51.7%) and 3)revocation of promotion committee refusal disposition：1 case(3.2%). Second, as for the computation of owners and consenters for land, etc., the competent authorities may prepare disputes by accurately confirming number of owners of land, etc. with promotion committees in advance when co-owners have complex relationships.
