공교육 측면에서 바라본 「대안교육기관법」 제정의 의미와 향후 과제

Abstract

This study explores the meaning of the enactment of the [AlternativeEducation Institution Act], enforced starting January 13th, 2022, from thepublic education system&s perspective and aims to elicit the next stepsneeded to be maintained to establish the registration system. First, thestudy summarizes the key information in the [Alternative EducationInstitution Act] and its decree and clarifies the rights and duties of thealternative education institutions registered under the superintendent ofeducation, and then proceeds to analyze the points of contention thatarose during the legislative process, through which the public meaning ofthe enactment of the law is rediscovered from the public educationsystem&s perspective. As a result, the findings can be summarized as: thepublic meaning of the law's enactment is that the change in publiceducation policy's directionality originates from outside the public educationsystem, the bounday between public and alternative education is nowmuddled, and that there has been an insitutional environment apt fordelivering accurate information to education consumers prepared. Thesteps needed to be taken in order to establish the registration system thatwere derived in this study are increasing the Ministry of Education orEducation Office's operation capacity, reviewing the policy directionality ofalternative education, seeking a common action plan for cities andprovinces to respond to unregistered facilities, and the datafication of theinformation obtained through the registration system. This study objects toexisting literature relating to the [Alternative Education Institution Act] byconsidering the meaning of the act through the perspective of publiceducation. Unlike prior research on the [Alternative Education InstitutionAct] that identify problems and offer solutions from a legal and institutionalangle, this study focuses on the public education perspective and exploresthe entrance of alternative education institutions into institutional territoryand suggests future tasks that need to be attended to by the publiceducation system
