수법의 체계구상 - 독자적 법역으로서 수법학의 성립가능성 대한 시론적 고찰 -

생명활동, 생산활동의 원천으로서 물의 이용, 보호는 인간의 삶을 사회적으로 조직하는 곳에서는 어디에서나 핵심적 쟁점이었다. 따라서, 모든 문화권은 어떠한 형태로는 물의 이용, 보호를 둘러싼 규범을 가지고 있다. 그러한 측면에서, 수법(水法)은 인류의 역사와 함께 발전해온 법사학적으로 가장 오래된 법역(法域) 중 하나라고 할 수 있다. 그럼에도 불구하고, 법제도 측면이 아닌, 학문적 연구의 대상으로서 수법에 대한 관심은 미진한 상태로 남아있다. 본고는 물의 이용, 보호와 관련한 법현상, 법이념, 법제도를 연구하는 독자적인 법학의 한 분과로서 이른바 수법학의 성립가능성을 타진하고, 시론적으로 그 체계를 구성해보는데 목적이 있다. 수법의 체계를 구상하는 작업은 통일적이고 일관된 원칙을 통해서 수법의 과제들을 유기적으로 배열하는 것을 뜻하는데, 전통적인 수법의 과제로는 물의 이용, 보호가, 현대적인 과제로는 좋은 물거버넌스체계의 구축이 있다. 전자가 실체법적 쟁점이라면 후자는 절차법적, 조직법적 쟁점에 관한 사항이라고 할 수 있다. 본고는 세계적 물관리관련 동향과 우리헌법의 가치정향을 고찰하여, 수법의 기본원칙으로, 공공성, 효율성, 민주성, 통합성, 보장성 등을 제시하였고, 그에 기초하여 수법을 물의 소유체계, 물의 이용체계, 물의 보호체계, 물의 관리체계, 물의 공급체계로 구분하여 재분류하였다. 물이 생명유지, 생산활동에서 담당해왔던 핵심적인 역할에도 불구하고, 수법의 체계화 작업이 상대적으로 더디고 분절적으로 이루어져왔음에 비추어, 본고가 통일적인 관점을 확립하여 수법의 이념을 밝혀내고, 그에 기초하여 수법의 과제를 재배열한 것은 유의미한 작업이라고 하겠다.
Abstract
The use and protection of water as a source of life activity and production activity are key issues where people organize life socially. Accordingly, every cultural area has a norm regarding use and protection of water in any form. In this sense, water law is one of the oldest areas of law in the legal history that has developed along with human history. Nonetheless, water law is not widely studied. This article aims to examine the possibility of establishing water law study as an independent legal division that studies legal phenomenon, legal principle and legal system related to the use and protection of water. The conceptualization of water law system is to arrange issues and tasks of water law systematically through unified and coherent principles. The traditional tasks of water law include use and protection of water, while contemporary tasks include development of a good water government system. Whereas the former is an issue of substantial laws, the latter is on procedural law and organizational law. This article examines the global water management trends and the command of the Constitution and suggests basic principles of water law. On this basis, water law is reclassified into possession system, use system, protection system, and supply system of water. Despite the key role of water in terms of life maintenance and production activity, the systematization work of water law has been relatively slow and segmental. Therefore, this article is significant as it illuminated the ideal of water law by establishing a unified perspective and rearranged the tasks of water law.
