동 연구 논문은 자연공원법을 고찰하여 자연공원 특히 국립공원 법제가 현재 공원 체제에 부합하는가하는 문제의식 속에 시작되었다. 과거 산악형 자연공원 외에 지질공원 및 테마 공원 등 새롭게 등장하고 있는 공원들이 기존 자연공원법 체제에 부합하도록 현재 자연공원법의 개념과 국립공원, 도립 및 군립공원 개념을 재정리하기 위한 입법론적인 논의를 전개하였다. 현행법에서 자연공원의 개념은 국립공원, 도립공원, 군립공원 그리고 지질공원으로 규정되어있는데 이는 자연공원의 법적 개념이라기보다는 관리주체에 따른 자연공원의 분류 및 새로운 지질공원의 추가적 개념에 불과하다. 동 연구논문은 이러한 자연공원과 국립공원 간의 개념적 혼선을 개선하기 위해 자연공원법의 전체적인 개정 내지 전체적 공원체제를 포괄적으로 담을 수 있는 법제정이 필요하다는 점에서 그리고 향후 지속적으로 등장 할 수 있는 새로운 유형의 공원을 포함 할 수 있는 가칭 국가공원법을 제정하여 문제점을 해결하는 방안을 제시하고 있다. 동 논문은 현재 자연공원법상 국립공원, 도립공원, 군립공원의 체제가 자연공원법의 기본적 이념인 지속가능한 이용에 부합하는지 여부를 검토하고 이에 대한 새로운 제언을 하고 있다. 특히, 자연공원법의 목적 중 지속가능한 이용이라는 개념이 자연공원의 보호·육성 의무와 동시에 조화 있는 개발·관리 의무를 모두 포함하는 개념이라는 점에서 이러한 분류 체제가 보전을 통해 공원 이용의 편익을 증대하는 정책에 부합하는지 살펴보고 있다. 자연공원의 현황을 통해 국립 및 군립공원은 활용 측면에서도 차이가 있어 지정기준도 동일하게 하지 않고 국립공원의 경우 지정기준을 엄격히 하고 군립공원의 경우 지정기준을 완화하는 것이 바람직하다는 점에서, 공원 내에서의 활동 및 재산권 행사가 엄격히 제한되는 국립공원의 지정과 관리·운영은 더욱 엄격하게 그리고 군립공원의 경우 지정을 용이하게 하여 소규모 공원 확대 정책을 통한 탐방객들의 이용 관람에 기여하며 나아가 해당 지역 내의 재산권행사 역시 국립공원보다는 용이하도록 하는 것이 바람직함을 제시하고 있다. 본 정책 제안은 가능한 지역 주민이 여가 및 정서 함양에 긍정적인 기여를 할 군립공원을 많이 지정토록 하고 관리측면에서도 목적에 부합하도록 운영하여 국민들의 자연공원 및 주제 공원 등 제 공원의 방문을 용이하도록 하고 이를 통해 여가활동을 활성화하여 국민 복리 증진을 도모하자는 데 그 취지가 있다.
Abstract
Natural Park is one of the best public assets that we can get benefits such as spiritual, scientific, educational, recreational and visitor opportunities. Also, we have responsibilities to preserve ecosystem of the parks areas for our next generation. This short paper reviews the legal system of natural park with Natural Park Act in order to analysis of its adequate functions. This paper focuses on three issues; first, the ultimate purpose of park system and the basic principle for the management of natural parks, secondly, legal definition of natural parks in Natural Park Act, finally, classification of natural parks. According to the Natural Park Act, the purpose of the act is preservation of natural ecosystem and sustainable use of natural parks. it is necessary to be balanced between two of them. The management policy of natural parks should be also well balanced. The sustainable use policy in neither over use nor too much limit on access to park. The ultimate aims of natural park system is for the best interest of publics not only this generation but also future generation. It is necessary to establish the basic principles of park management which is not now in the law. Moreover, it is also necessary to have adequate legal definition of natural park in order for classification of parks. The current trends of new type of parks such as geoparks, and theme parks in the national parks system show us that this legal system cannot regulate all type of parks in the categories of natural park for its definition. The definition of natural parks would be area which is designated by the laws and regulation for the significance or magnitude of its natural value and preservation. However, current law provides legal definition of natural parks as national parks and provincial parks. This paper proposes that it is seriously needed that new amendment of Natural Parks Act in order to reflect to these legal problems. Although national parks shall be preserved more, small scale provincial park shall be designated and open the access to public for its use with visitors facilities; and it is proper for sustainable use of natural parks.
