Abstract

On June 28, 2024, the U.S. Supreme Court overturned the Chevron Doctrine in Loper Bright Enterprises v. Raimondo. The Chevron Doctrine had long required the judiciary to defer to reasonable interpretations of law by the executive branch, especially in environmental conservation areas such as climate change, serving to fill legislative gaps. However, with Chevron overruling, the courts are now expected to directly interpret laws when administrative regulations are ambiguous or incomplete, leading to an anticipated surge in lawsuits challenging environmental regulations. Environmental regulations require proactive administrative involvement due to advancements in science, changing societal values, and national policy directions. The increased judicial scrutiny is expected to present significant challenges to the efficiency of administration. In particular, wetland conservation under the U.S. Clean Water Act has been subject to various legal disputes due to the law's ambiguous provisions, but the U.S. Environmental Protection Agency's (EPA) proactive wetland conservation efforts had been respected under the Chevron Doctrine. The Clean Water Act regulates discharges into national waters and grants the authority for dredging and filling permits to the U.S. Army Corps of Engineers and the EPA. This policy played a key role in wetland conservation. However, the Act only specifies that “navigable waters” are national waters, leaving the definition of national waters unclear. The EPA and the Corps of Engineers interpreted the law broadly, including isolated wetlands and intermittent streams in their conservation efforts. This led to legal challenges arguing that non-navigable wetlands should not be included, and the Supreme Court ruled that, while non-navigable wetlands may be protected, they must be closely connected or have a significant relationship with navigable waters. In 2023, in Sackett v. EPA, the Supreme Court reduced the scope of protection under the Clean Water Act. The Court ruled that only wetlands that are “relatively permanent” or have continuous flow, such as rivers and lakes, should be protected. Additionally, it held that adjacent wetlands must be “inseparable” from national waters to be considered protected. As a result, about half of previously protected wetlands and 80% of streams were excluded from protection, which has been criticized as a setback for environmental protection. The Supreme Court has distanced itself from the Chevron Doctrine, focusing more on the text and structure of the law. In Sackett, the Court rejected the executive's interpretation and substantially reduced the scope of wetland protection. In 2024, in Loper Bright, the Court formally abandoned the Chevron Doctrine. The Court argued that when a law is ambiguous or incomplete, it is unconstitutional and inconsistent with the Administrative Procedure Act for the courts to defer to the executive's interpretation, as it infringes upon the judiciary’s exclusive authority to interpret the law. This abandonment of the Chevron Doctrine has been criticized for leading to judicial overreach and potentially hindering administrative efficiency. Wetlands are vital ecological assets, and once damaged, their ecological functions are difficult to restore. The Clean Water Act does not explicitly define wetlands but has historically included them in the scope of national waters for protection due to their hydrological and ecological significance. In South Korea, although there are efforts to protect wetlands through designating conservation areas, the country's wetland conservation laws do not sufficiently account for their hydrological characteristics. As a result, wetland degradation is generally permitted, and only designated conservation areas are protected, revealing inherent limitations. To prevent further wetland degradation and prioritize the preservation of their ecological functions, legal reforms are necessary. In addition to strengthening regulations, non-regulatory measures such as ecosystem services payment schemes and the activation of wetland conservation land rights should be encouraged to promote private conservation efforts. Expanding the responsibility for wetland conservation from the government to citizens will help enhance the efficiency of the national wetland conservation policy.
