에너지 안전보장의 법정책적 검토 시론(試論) ― 기후위기 시대의 지속가능한 에너지 안전보장 ―

기후위기 시대에 접어들면서 탄소중립을 향한 에너지 전환이 가속화되고 있다. 전통적인 에너지원인 화석연료 뿐 아니라, 에너지 전환에 필요한 핵심 광물의 가격 상승과 그로 인한 안정적인 수급의 어려움이 배가(倍加)되고 있는 실정이다. 여기에 더하여, 러시아-우크라이나 갈등은 세계 패권이 에너지를 중심으로 작동하고 있음을 새삼 깨우치게 한다. 위와 같은 배경 속에서 강조되는 개념이 바로 ‘에너지 안전보장’이다. 에너지원의 90% 가량을 수입에 의존하는 우리에게는 더욱 그러하다. 여기에 터 잡는다면 에너지 안전보장이라는 개념이 ‘에너지의 안정적인 공급’과 등치된다는 사실에 그다지 놀라지 않을 것이다. 그럼에도 불구하고 현실에서의 인식과는 별개로, 여기에 대한 규범적이고 학문적인 검토를 통해 그것이 나아가야 할 방향과 추구해야 하는 바를 세련(洗練)할 필요가 있다. 본 글은 에너지 안전보장의 개념에 관한 나름의 고찰과, 그것이 가지는 몇 가지 특성에 주목한다. 리스크적 특성과 조정 문제로서의 성격이 바로 그것이다. 이러한 견지에서 에너지 안전보장의 문제는 법률이 가지는 표현적 기능에 의해 대응되어야 함을 강조한다. 또한, 에너지 안전보장과 관련하여 근래에 발의된 두 가지 입법안의 내용을 검토함으로써 우리 사회가 해당 개념을 어떻게 바라보고 또한 어떻게 추구하고 있는지에 관한 실재적인 이해를 덧붙인다. 무엇보다, 본 글은 에너지 안전보장이라는 국내에서 학문적으로 논의되지 않은 개념을 탐구하는 시론(試論)이라는 점을 강조한다.
Abstract
Notwithstanding climate crisis have accelerated energy transition for carbon neutrality, greenflation and the Russia-Ukraine conflict recalled the energy security. This trend is especially crucial for Korea, where is well-know as the country of energy poverty. It naturally made us grasp why energy security is equivalent to a stable supply of energy in this nation. However, the normative discussion of the concept of energy security is imperative not only to shape the current understanding but also to draw the nature and direction to pursue the value of energy security. Two bills on energy security will be a valuable materials for this task. As a result, this paper suggests that it has the characteristics of coordination problem and risk. From this perspective, we assert that the law has a vital role to solve the aforementioned issues through the expressive function of the law. Last but not least, this research is expected to be a stepping stone for the further discussion.
