사이버 공간은 인터넷을 기반으로 하는 가상공간이다. 인터넷은 그 시작부터 본질적으로 중앙이 따로 없는 분권적 통신망으로 계획된 것으로서 중앙 집권적 통제가 없는 일종의 무정부적 통신망이다. 사이버 공간은 현실 공간에 비해 국경이 없는 범세계적 공간이자, 외적 권위나 제재로부터 자유로운 공간이다. 자유의 공간으로서 사이버 공간은 모든 개인에게 표현의 자유에 대한 막강한 힘을 부여하였다. 정보통신 기술의 발달은 인류에게 많은 편리와 혜택을 주었지만, 그에 못지않게 새로운 문제를 야기 시키고 있다. 인터넷과 사이버 공간에서 벌어지는 각종 부정적 현상 가운데 가장 적나라하고 심각하게 나타나는 영역은 다른 어떤 것보다도 성적인 문제와 관련된 영역이라고 할 수 있다. 사이버 공간에서 유통되는 정보들 가운데 상당 부분을 음란물이 차지하고 있다. 청소년들이 가상공간에서 음란물사이트에 접근하는 것을 막기 위한 장금장치 마련이 제도적으로 요청되고 있으나 문제는 가상공간에서의 음란물에 대한 규제를 허용하여야 한다는 주장과 헌법상 보장된 표현의 자유라는 기본권을 내세워 규제불가라는 주장이 서로 팽팽하게 맞서고 있다. 그러함에도 불구하고 가상공간에서의 음란물 등 불건전정보의 차단을 위해서는 기술적법적제도적 대응방안이 강구되어야만 한다. 이 중 기술적 대응방안으로는 첫째 유해정보의 DB구축 및 차단 소프트웨어의 보급 확대를 들 수 있다. 국내 ISP의 Router 혹은 proxy서버를 통하여 IP address 또는 URL별 필터링이 가능하므로 차단하고자 하는 해외 유해사이트를 등록하여 선별적 접근이 가능하게 한다. 그리고 인터넷 관리자, 학교, 기업, 공공기관의 LAN 서버에 차단 소프트웨어를 설치, 운영하도록 하며, 개인 PC에도 차단 소프트웨어를 설치하도록 보급을 확대하여야 하며, 인터넷 정보내용등급제를 적극적으로 추진해야 할 것이다.
Abstract
The Cyberspace is a virtual space based in the Internet. The Internet has clearly expanded the potential for individuals to exercise the right to freedom of expression. The net gives all of users a vast expressive power if they choose to take advantage of it. For example, users can operate their own bulletin boards, publish electronic newsletters, or establish a home page on the Web. According to Michael Godwin, the net "puts the full power of 'freedom of the press' into each individual's hands." As a result, the issues of free speech and content control in cyberspace has emerged as arguably the most contentious moral problem of the nascent Information Age. Human rights such as free speech have taken a place special prominence in this century. In some respects, these basic rights now collide with the state's inclination to reign in this revolutionary power enjoyed by Internet users. Those who pioneered Internet technology have consistently asserted that the right to free expression in Cyberspace should have as broad a scope as possible. For many years, the Government was reluctant to restrict or filter any form of information on the network for fear of stifling an atmosphere that thrives on the free and open exchange of ideas. At the heart of the debate about the content regulation is the basic question that was raised about how the Internet should be controlled. Should government impose the kind of controls embodied in this legislation? Or should the Internet be managed and controlled through a more bottom-up, user-oriented approach, with users empowered to develop their own solutions tailored to their own needs and value system? However, the increased use of the Internet, especially among more vulnerable segments of the population(such as young children), forced some public policy makes to rethink this laissez-faire approach.
