정의윤리와 배려윤리의 관계에 대한 논쟁은 길리건이 배려윤리를 주장하면서부터 시작되었다. 콜버그는 정의윤리는 공평성과 보편성을 도덕성의 본질적 요소로 규정하고 있기 때문에 도덕적으로 부수적인 문제에 관여하고 있는 배려윤리보다 우선한다는 입장이다. 길리건은 기본적으로 여성적 특성과 경험을 반영한 배려윤리는 정의윤리와 대등한 가치를 지닌 독립적인 윤리라는 입장을 전제로 두 윤리의 관계를 탐구한다. 두 윤리의 관계에 대한 논의는 크게 3가지로 요약할 수 있다. 첫째, 정의나 배려 중 어느 하나가 우선적이라고 보는 입장 둘째, 두 윤리는 서로 대등하면서 독립적인 관계를 갖는다는 입장 셋째, 두 윤리는 상호 의존적이고 상대윤리에게 도덕적 기초를 제공해 준다는 입장이다. 본 논문에서는 바람직한 두 윤리의 관계를 세 번째 관점으로 상정하고 두 윤리의 장점과 적절성을 결합한 통합적인 관점에서 도덕적 문제들에 접근할 것을 제안하였다. 두 윤리를 상호 의존적인 것으로 인식하고 통합을 추구하면 도덕적 문제를 정의와 배려, 그리고 둘을 통합한 제 3의 관점에서 다양하게 인식할 수 있고, 보다 조화롭고 포괄적인 해결방안을 도출 할 수 있기 때문이다.
Abstract
The Principal aim of this Article is to explore the relevant relation between the ethics of Justice and the ethics of Care. The main debates on the relation between justice and care are three kinds. One of them are the view to regard justice or care as morally primary. This view can take two forms, depending on whether justice or care is regarded as basis or primary. Secondly, the view is that the ethics of Justice and the ethics of Care are independent, equal and distinct moral voices. They suggest each ethics is associated different problem solving strategy, suggesting that each of them facilitates different kinds of moral reasoning and constitutes different ways which organize a problem and think about what is happening and what to do. Thirdly, one of the two ethics provides a foundation for the other ethics. The ethics of justice is a precondition for morally adequate care, an ethic of care is a precondition for adequate justice. Some of them argue that the interdependence of care and justice and interaction of them result in convergence into comprehensive ethics that incorporates all the morally relevant in two ethics. Finally, I argue that the two ethics need each other both logically and instrumentally are complementary, so they need to be synthesized into a comprehensive moral theory.
