미국과 호주의 자원봉사자 보호법 비교를 통한 입법적 제언

본 연구는 미국과 호주의 자원봉사자 보호법에 제시된 입법 목적과 정책 수단을 기능적 비교법 연구를 통해 분석하여 한국의 포괄적 자원봉사자 보호 체계 설계를 탐색한 기술적 연구이다. 미국과 호주의 법은 자원봉사자를 민사책임으로부터 보호하는 것을 핵심으로 비영리조직과 자원봉사자의 책임 범위 및 법적 보호 요건을 명확히 하고 있다. 특히 호주는 직장 건강 및 안전법을 자원봉사자가 활동하는 1인 이상 유급 직원 사업체에 적용하여 일상적 위험을 예방하는 법체계도 마련하였다. 기관 가입 보험을 채택하고 있는 미국, 호주와 달리 정책형 자원봉사보험을 중심으로 시행하는 우리나라에서 향후 자원봉사 현장에서 발생하는 다양한 종류의 위험과 법적 위험까지 포괄할 수 있는 새로운 자원봉사자 보호 체계 마련과 입법과제를 제언한다.
Abstract
This study is a basic research exploring the design of a comprehensive volunteer protection system in Korea by analyzing the policy measures presented in the Volunteer Protection Act in the United States and Australia. The laws of both countries stipulate the scope of responsibility and legal protection requirements for non-profit organizations and volunteers, with the immunity from civil liability. In particular, Australia has established a legal system to prevent day-to-day risks by applying the Work Health and Safety Act to all volunteers in all organizations where volunteers work. Unlike the United States and Australia, which adopt institutional insurance, Korea implements policy-type volunteer insurance as the main protection system. This study propose a new volunteer protection system and legislative task in Korea that encompasses various risk categories of volunteers and protective measures to respond to them.
