본 연구는 유럽의회의 학대방지모델과 생태체계모델을 결합하여 생태적학대방지모델을 도출하고, 이 모델을 통하여 9개의 정책 영역을 설정하였다. 이를 적용하여 아동학대와 관련된 법률인 영유아보육법, 아동복지법, 아동학대범죄의 처벌 등에 관한 특례법을 분석함으로써 우리나라 아동학대 정책을 평가하였다. 분석 결과 현재까지 우리나라의 아동학대 정책은 학대를 피해자와 가해자 간의 문제로 보고 서비스 제공기관이나 제공자에 대한 규제정책과 학대피해 발생 후 피해아동을 지원하는 정책에 집중하고 있었다. 이 외에 학대예방을 위해 서비스 제공기관 및 제공자에게 규제를 가하는 정책, 사회차원에서 인식개선을 통한 학대예방정책, 학대사건 종료 후 개인 및 서비스 제공기관에 개입하는 정책. 개인차원에서의 학대예방을 위한 정책이 일부 존재했다. 하지만 거시체계에서의 학대발생 후의 정책은 전혀 존재하지 않았다. 따라서 아동학대에 제대로 대처하기 위해서는 학대발생 이후 개인 및 기관에 대한 개입 정책 이외의 나머지 7개 영역에 대한 정책이 더 개발될 필요가 있다.
Abstract
This study is to evaluate the child abuse preventive policy in Korea by analysing Infant Care Act, Child Welfare Act, Act on Special Cases concerning the Punishment of Child Abuse Crimes. This study evaluates the policy by applying ecological abuse preventive model, a combination of the European Council abuse preventive model and the ecological model. The evaluation indicates that child abuse preventive policy in Korea has been focusing on the support for victims and monitor of service providers by regarding child abuses as the problem between victims and offenders. However, it seems to be out of balance and there was no abuse-responsive policy at macro level despite the importance of these policies. Therefore, it is necessary to develop more comprehensive and well-balanced policies for child abuse issue.
