이 글의 목적은 벤담 ‘헌법전’에서 입법부의 권한, 기능, 그리고 구조에 대하여 정리･이해하는 것이고, 이를 통해 벤담 ‘입법부’의 체계와 특징을 파악하고자 한다. 그의 헌법전에서 ‘입법부’를 이해하기 위해서는 벤담의 공리주의와 법전화 이론을 이해하는 것이 필요하다. 벤담이 제시한 원칙으로는 입법부의 최고성, 유권자의 근본적 권한, 공리성 원칙에 따른 구성, 계속성 원칙과 회의 공개 원칙, 1년 임기, 무노동 무보수, 책임과 소양 등이 있다. 또한, 현대 국가에 도움이 되는 창의적이고 합리적인 여러 원칙과 제도들을 다양하게 제안하였다. 벤담의 가장 포괄적인 ‘헌법전’의 구성에 있어서 당연하게 그 목적은 통치자와 피치자 전체의 공동체의 최대 행복이고, 최대 행복원칙이 근본 원칙이다. 궁극적으로 벤담은 이 작업을 통해 완전한 법체계, 즉 Pannomion의 기획의 토대를 마련했고, 그 결실의 하나로 ‘헌법전’을 구상한 것이다.
Abstract
The aim of this study is to overview the power, function and structure of the Legislative body in Bentham’s ‘Constitutional Code,’ and thereby to understand system and characteristics of Bentham’s ‘Legislative Authority.’ In order to understand the Bentham’s perception on the Legislature in his Constitutional Code, it is necessary to contextualize Bentham’s theory of utilitarianism and codification. In Section of the Legislature in Bentham’s Constitutional Code, he proposed several governing principles of the Legislature: Legislative Supremacy, Principle of Utility, Principle of Continuation, Principle of Public sitting, Annual Term of Service, Responsibility and Aptitude, and No-work-No-Remuneration. Also, The purpose of the Bentham’s comprehensive Constitutional Code is the greatest happiness of the whole community of both governors and governed, the greatest happiness principle should be the fundamental principle. Ultimately, Bentham attempted to lay the foundation for the plan of the complete body of laws, ‘Pannomion’ and tried to codify Constitutional Code.
