규제시차의 이론과 실제 : 산업융합 신제품 적합성 인증 사례를 중심으로

초록

기술발전의 속도가 가속화되면서 규제시차(regulatory lag)로 인한 사회적 손실이 커지고 있다. 규제시차는 정책시차의 하나로서 규제문제의 발생시점과 해결시점 사이의 시간차이를 의미한다. 규제시차는 규제의 생성 시점을 기준으로 내부시차와 외부시차로 구분된다. 본 연구는 규제시차에 대한 이론 논의를 통해 분석틀을 구성하고, 이를 활용하여 내부시차가 문제되는 산업융합 신제품 적합성 인증 사례를 분석한다. 또한 내부시차를 줄이기 위한 정부의 노력과 개선 방안을 토론하고, 신제품 적합성 인증 기준과 관련된 한국과 미국의 법령을 비교함으로써 규제시차 발생의 감소 방안을 논의한다. 본 연구는 규제시차에 대한 이론 논의를 시도하는 점에서 이론적 의의가 있고 규제시차 감소 방안을 제시하는 점에서 정책적 함의가 있다.

Abstract

As technological development is accelerating, regulatory lag lays heavier burdens on our society. Regulatory lag is a type of policy lags and is defined as the difference in time between occurrence and resolution of regulatory problems. Regulatory lag consists of inside and outside lag; the former is an amount of time consumed before regulation is created and the latter is an amount of time it takes until the government applies the regulation to specific problems. This study formulates the analytic frame through theoretical discussions on regulatory lag; using this tool, cases of conformity assessment are examined, in relation to new products from technological convergence, where the inside lag to be problematic; this study introduces efforts by the government to diminish the inside lag and discusses on how to improve such a problem. Additionally, this study compares the legal approaches to conformity assessment standards in South Korea and the United States and discusses measures to minimize the risk of regulatory lag. The Significance of this study and its implication on policies can be found in the theoretical discussion of regulatory lag and methodologies to reduce it.
