감염병 위기대응과 신체의 자유 제한에 대한 고찰

코로나19 바이러스의 대유행은 전세계에 사회･경제적으로 큰 타격을 주고 있고, 그 차단을 위해 대대적인 역학조사와 함께 전례 없는 사회적 거리두기가 장기간 실시되면서 일상이 비대면 사회로 급격하게 전환되고 있다. 또한 역학조사를 통해 코로나19 확진자를 발견한 후 추가 전파를 차단하기 위하여 코로나19 환자 외에 그 접촉자 등도 입원 내지 격리조치가 이루어져 신체의 자유가 제한되기도 한다. 감염병 위기대응은 일본과 미국에서도 법제를 통하여 규율하고 있는데, 이들과 비교할 때 우리나라의 법제는 감염병 위기대응 방해행위에 관한 처벌이 상대적으로 가중되어 있고 실제 사건에 대한 법원의 선고형도 높게 책정되고 있다. 하지만 감염병에 대한 위기대응도 중요하지만 그 방해행위자에 대한 처벌에서, 「감염병의 예방 및 관리에 관한 법률」의 목적과 취지를 고려하고 국민 개인의 인권에 대한 침해를 최소화하기 위한 법제적, 사법적 고려가 필요하다.
Abstract
The world is being hit socially and economically due to the pandemic of the Covid-19. In order to block Covid-19, a large-scale epidemiological investigation and unprecedented social distancing have been carried out for a long period of time, and daily life is rapidly turning into a non-face-to-face society. Furthermore, after finding a Covid-19 confirmed person through an epidemiological investigation, not only the Covid-19 patient, but also the person in contact with the Covid-19 are hospitalized or quarantined, thereby limiting the freedom of human beings. Crisis responses to infectious diseases are regulated through legislation also in Japan and the United States. However, the legal system in Korea has relatively increased penalties for interfering with infectious diseases crisis response, and the court's sentence for actual cases is also high. In punishing those who interfere with them, the purpose of the 「Act on the Prevention and Management of Infectious Diseases」 are considered. In addition, legal and judicial considerations are needed to minimize violations of the human rights of individuals.
