우리나라 중대재해처벌 관련 법제의 개선방안 연구: 「중대재해처벌법」을 중심으로

최근 국회는 본회의에서 「중대재해 처벌 등에 관한 법률」 제정안을 의결한 바 있다. 이는 중대재해를 예방하고 시민의 생명과 신체를 보호함을 목적으로 제정된 것인데, 관련 각계로부터 1) 법령체계, 2) 적용범위, 3) 구성요건, 4) 가중요건 등과 관련하여 다양한 문제점이 지적될 수 있는 상황이다. 본 연구는 본 법의 주요내용과 이에 대하여 대표적으로 지적될 수 있는 문제점을 분석하고, 개선방안을 제시하고자 하였다. 첫째, 본 법이 명확히 특별법적 성격으로 해석되도록 명시하는 것이 필요하다. 둘째, 본 법의 적용에서 5명 미만 사업장 등을 제외하는 것이 입법목적에 부합하는지, 그 합목적성을 점검해볼 필요가 있다. 셋째, 안전 및 보건 확보의무의 자의적 해석 소지를 제거하고, 논란의 소지를 최소화하는 입법개선이 필요하다. 넷째, 본 법에서 규정하고 있는 처벌의 구성요건 및 가중요건이 중대재해 방지를 의도함에 충실한지를 고려한 입법개선이 필요하다.
Abstract
Recently, The National Assembly passed the 「Severe Accident Punishment Act」, which is intended to prevent severe accidents and protect citizens’ lives. However, various problems are expected to be pointed out from related fields regarding the problems of 1) relationship to other statues, 2) scope of application, 3) criminal elements, 4) aggravated punishment, etc. This study analyzes the main contents of this Act as well as the problems that can be pointed out against it. Then it presents improvement measurements as follows: it is necessary to 1) specify that this act is clearly interpreted as a special legal character, 2) check whether excluding small business sites from the application of this act meets its legislative purposes, 3) remove the arbitrary interpretation of obligations and minimize the possibility of controversy, 4) make legislative improvements considering whether the criminal elements and elements for aggravated punishment prescribed in this Act is faithful to its intentions.
