북한군의 월경 한국 민간인 사살에 대한 법적 고찰

2020년 9월 22일 밤 10시경 비무장의 한국 민간인이 북한 해역에서 북한군의 총격을 받고 살해되는 일이 발생했다. 이 사건 처리 과정에서 북한은 자유권규약과 전시민간인보호협약 등 국제법규범이 요구하는 생명권 존중 및 국제인도법상의 처리절차를 준수하지 않았다. 또한 해상수색 및 구조에 관한 국제관습법에 따른 구조도 실시하지 않았다. 이 같은 처우는 자위권 행사나 법집행조치로 정당화될 수 없다. 필요성과 비례의 원칙을 전혀 충족하지 못했기 때문이다. 북한군의 행위는 국가책임법상 ‘하급기관’의 행위로서 국제법주체인 북한(DPRK)에 귀속된다. 그에 따라 국가책임을 져야 한다. 그런데 북한은 충분할 정도의 책임해제 조치를 취하지 않았다. 북한 조선로동당 통일전선부가 보낸 통지문에서는 미안하다는 뜻을 밝히고 있어 유감 표명으로 볼 여지는 있지만, 국제법상의 ‘사과’에 해당한다고 볼 수는 없다.
Abstract
An Unarmed South Korean civilian was shot down by Korean People’s Army(KPA) soldiers in the territorial waters of North Korea(hereinafter abbreviated as NK) around 10 O’clock on 22 September, 2020. In the course of dealing with this incident, NK did not pay respect for the international norms of the right to life, prescribed in the International Covenant on Civil and Political Rights(ICCPR) or Geneva Convention Ⅳ on Protection of Civilian Persons in Time of War, and also the relevant procedures of international humanitarian law. Moreover, NK did nor perform the rescue of a South Korean person in distress at sea in accordance with international customary law on maritime search and rescue. Such treatment could not be justified by the exercise of right to self-defence or law enforcement measures. It’s because that NK’s action did not entirely fulfill the principles of necessity and proportionality. NK’s soldiers’ acts, including physical assaults, killing, defamation of dead body etc, could be attributed as so-called “acts of inferior organs” to NK itself. So NK should take responsibility for their unlawful acts. Notwithstanding the fact, the country did not carry out satisfactory measures until now. Unfication Front Department under the NK’s Workers’ Party sent a letter to South Korean Blue House on 25 September, 2020. The words used in the notice could de interpreted as a kind of “expression of regret” in relation to the North Korean Soldiers’ responding acts. But it can not correspond to apology in any way under international law of state responsibility.
