주요 국가들의 입법례를 통한 상가건물임차인 보호 방안

「상가건물임대차보호법」의 목적은 공정한 거래질서를 확립하고 영세 상인들이 안정적으로 생업에 종사할 수 있도록 과도한 임대료 인상의 방지와 임차인의 권리를 보장하기 위하여 상가건물 임대차에 관하여 민법에 대한 특례를 규정하여 국민 경제생활의 안정을 보장하기 위한 목적으로 2001년 12월 29일 제정되어 2002년 11월 1일 부터 시행되었다. 특히 2001년 제정된 상가임대차보호법은 경제적 약자인 임차인을 보호하기 위한 목적으로 상가건물의 임대차에서 임대인의 임차인에 대한 임대료의 인상, 임대차계약 해지권의 남용, 임대차 기간 보장의 불안정, 월세산정에서 고율의 이자 적용, 임대인의 임차건물 등기의 불협조 및 임대인이 임대보증금을 반환하지 않는 등의 문제를 해결하기 위한 목적이었으나, 본 법의 적용범위와 관련하여 보증금한도액과 보증금 외에 차임이 있는 경우 보증금에 포함시키는 비율 등의 과도한 위임규정, 공시의 효력발생시 기의 부적절성, 계약갱신거절권과 과도하게 임차인을 보호하도록 하는 규정 등 일부비 판이 있었다. 이 같은 지적에 따라서 2015년 5월 13일 본 법률의 일부개정이 있었는데 이번 개정은 매우 의미 있는 개정으로 평가되었다. 그럼에도 불구하고 많은 문제점들이 지적되고 있는 가운데 2018년 9월 20일 상가건물임대차보호법의 주요쟁점과 관련한 개정 법률안이 국회를 통과하였다. 본고에서는 현행 상가건물임대차보호법을 둘러싸고 나타나는 제 문제 및 주요 국가들의 관련 법제를 검토하여 상가건물임차인 보호를 위한 방향성을 모색하였다.
Abstract
The Commercial Building Lease Protection Act was enacted on December 29, 2001 to establish a fair trade order and to secure the right of tenants to prevent excessive rent increases so that small traders can be engaged in stable employment. Especially, the Commercial Lease Protection Act of 2001 was designed to protect the tenant who is economically weak. In order to protect the tenant, it is necessary to increase the rent for the tenant, to abolish the lease term, The application of the interest, the uncoordination of the landlord's registration of the landlord, and the failure of the landlord to return the rental deposit. However, in relation to the scope of application of this law, if there is a chage in addition to the deposit limit and the deposit, excessive delegation regulations such as the ratio of inclusion in the security deposit, inadequacy of the validity period of the disclosure, refusal of contract renewal, There were some criticisms such as the regulations. In light of this point, some amendments were made to this Act on May 13, 2015, and this amendment was evaluated as a very meaningful amendment. Nevertheless, many problems have been pointed out, and on September 20, 2018, the amendment bill related to major issues of the Commercial Building Lease Protection Act passed the National Assembly. In this paper, we examined the problems surrounding the current leasehold lease protection law and related laws of major countries and searched the direction for the protection of the leaseholder of commercial buildings.
