Abstract

Human rights norms have been regarded as a universality that all people have today, but they should be understood as being a “relative universality” rather than a fixed immutability. Only then can the universality of human rights norms have significant meaning when fully implemented on the domestic level in actuality. Otherwise, these norms are merely promulgated or prescribed in international human rights treaties. The value of human rights depends on their actual domestic implementation, so their adaptability to differing cultures is imperative to their actual use in each country. International human rights treaties, unlike other international laws, have constitutional normativity, and they have sometimes been considered international customary laws or jus cogens. In these regards, the international human rights treaties should be considered to have constitutional status, at least above the domestic legislations in the domestic legal system, because they have some characteristics that other international laws do not have. Giving these treaties constitutional status can help the highest national courts work as primary actors, using the international human rights treaties in their domestic courts, to protect and promote human rights on the domestic level because they, with their powerful legal authority, can provide appropriate resolutions and effective remedies for human rights violations occurring on the domestic level. In this sense, if the highest national courts invoke international human rights treaties in cases involving human rights, domestic human rights protection systems could be strengthened because invoking them does not break the unity of domestic legal system. Therefore, the Constitutional Court of Korea should use the international human rights treaties on domestic human rights cases in the same way that the U.S. Supreme Court has often referred to them in recent times. This also can be accomplished by amending the South Korean Constitutional Court Act, simply adding a clause regarding international human rights treaties, similar to how the South African Constitution requests that the Constitutional Court must consider international human rights treaties on domestic human rights cases.
