불임 치료의 방법으로 현재 널리 사용되고 있는 체외수정(In Vitro Fertilization and embryo transfer ; IVF)을 통하여 난자와 정자의 채취에서부터 수정 및 착상에 이르기까지의 생식 과정 전체에서 인간의 인위적 개입이 가능해지게 되었다. 착상 전 유전자 진단(Preimplantation Genetic Diagnosis ; PGD)이란 부부의 난자와 정자를 체외수정해서 얻은 수정란을 여성의 자궁에 착상하기 전 미리 유전자 정보를 검사하는 기술을 말한다. 착상 전 유전자 진단 방법을 사용하면, 미래에 부모의 병이 유전될 아이와 그렇지 않은 아이를 미리 알 수 있고, 가장 건강한 수정란을 골라 자궁에 이식함으로써 유전질환의 대물림을 끊을 수 있다는 장점이 있기 때문에, 이미 전 세계에서는 난치성 유전병에 걸린 수천 명의 사람들이 착상 전 유전자 진단의 힘을 빌려 건강한 2세를 출산했으며 그 발길은 지금도 계속되고 있다. 착상 전 유전자 진단의 출현은 새로운 과학적, 사회적, 윤리적, 법적 문제를 야기하였다. 착상 전 유전자 진단에 대한 기본적인 사회적 문제는 착상 전 유전자 진단이 언제, 어떤 기관, 어떤 규정에 따라 시행되어지는가 하는 것이다. 착상 전 유전자 진단은 앞으로 태어날 아기에게 영향을 미칠 수 있는 위험성이 가장 큰 문제가 되고 있다. 따라서 유럽의 경우 착상 전 유전자 시행 기관에 대하여 정부의 일정한 기준을 정하여 승인해 주는 형태를 취하고 있고, 충분한 능력이 있다고 판정되는 제한된 시설에서만 시행되고 있다. 본 논고는 착상 전 유전자 진단의 내용을 살펴보고, 헌법적인 시각에서 배아의 법적 성격과 생명권에 대하여 분석하고 있다. 그리고 외국의 입법정책을 살펴보고, 이를 토대로 우리나라 입법정책의 문제점과 해결방안을 연구하도록 한다.
Abstract
No doubt, assisted reproductive technologies may contribute substantially to human well-being. However the reproductive revolution raises a wave of moral questions concerning the responsibilities of prospective parents, the scientists involved, and society as a whole. This holds true particularly for preimplantation genetic diagnosis(PGD), which aims at a selective transfer. PGD was primarily developed in response to requests for help from people at high risk of passing on a serious genetic disorder to their children. This research considers ethical and legal aspects of preimplantation genetic testing. Possible categorical moral objections to PGD concern the biopsy, the selection of embryos, the burdens and risks of the preceding in vitro fertilization procedure, the slippery slope, and the link with embryo research. This study will differentiate human embryonic stem cells from other types of stem cells and frames the ethical and legal controversy surrounding human embryonic stem cell research, including patentability, too. The Genetic Information Nondiscrimination Act of 2008 (GINA) prohibits discrimination based on genetic information by health insurers and employers. This research is forcused on analysising the legal, ethical standards in Bioethical and Legal Issues on PGD method of Embryos, and comparing the foreign laws with the Law on Bioethics and Biosafety(the Bioethics Law) for the desirable amendsment of the existing Bioethics Law in the viewpoint of public policy. After the Law on Bioethics and Biosafety has been enacted since 2005, Preimplantation genetic diagnosis(PGD) for embryo and Prenatal diagnosis(PD) for fetus are regulated by this law. The Purpose of this study is to examine the problems of the Use and Protection of Preimplantation genetic Diagnosis in Korea and to suggest thereby the way that can improve the law-related perspective.
