초록

본 논문은 착상전유전진단의 생명윤리적 고찰을 과학적 측면과 인간배아의 지위의 문제와 함께 시도한다. 본 논문에서, 인간배아의 지위는 어떤 법적인 절차나 사회·문화의 동의를 거쳐 규정하는 차원이라기보다는 그 존재론적 정체성에 대한 질문에서 고찰할 필요가 있음을 제기한다. 인격으로서 인간배아는 수정된 순간부터 반복될 수 없는 유일한 개별체로서 존엄성을 가지며, 그의 양도할 수 없는 기본권은 수정시부터 죽는 날까지 모든 인간이 갖는 생명권과 신체의 완전성을 침해당하지 않을 권리이다. PGD가 치료의 목적을 추구할 수 있게 된다면, 그것은 개입의 대상인 주체, 즉 인간배아를 위한 것이어야 하며, 어떤 사람의 이익을 위해 인간배아를 희생시켜서는 안 된다. 그러므로 오직 PGD의 주체인 한 생명의 구체적인 배아를 위한 치료적 이유가 있을 때 정당화 될 수 있을 것이다.

Abstract

This paper attempts to consider the bioethical issues of preimplantation genetic diagnosis (PGD) with scientific aspects of PGD and the question of the status of the human embryo. In this paper, it raises an issue that the status of the human embryo needs considering from the question of the ontological identity rather than defining the status within the process of law or social and cultural consent. The human embryo as a person has dignity owing to a unique individual from the moment of fertilization, and the inviolable fundamental right for every human person is the right to life and physical integrity from the moment of conception until death. When it comes to saying that the aim of PGD is treatments, it should be performed for the human embryo who is the subject of the diagnosis. It cannot be permissible to sacrifice one person (the human embryo) for another's interest. In this regard, PGD may be justified only when it treats this concrete human embryo who has a human life.
